President Barack Obama is talking tough about a new series of executive orders that are designed to curb gun ownership and trample Americans’ Second Amendment rights.
But his latest measures likely don’t have much of a chance of ever surviving a judicial review.
Obama will provide the full details today on a new set of executive actions his administration has been promising for much of his presidency. The orders will expand background checks on guns and target the gun resale market, especially the so-called “gun show loophole.”
Republican presidential candidates are already fuming about Obama’s attempts to bypass the legislative process, with candidate Donald Trump vowing to “un-sign” Obama’s orders.
But it’s possible that Obama’s gun-control measures might not survive that long.
While presidents have worked to expand the use of executive orders (originally designed to handle administrative tasks) over the years, the law has remained clear on how they can be used.
The United States Supreme Court issued a ruling in Youngstown v. Sawyer more than 60 years ago forbidding presidents from using executive orders to defy the will of Congress. And Congress has repeatedly failed to pass the gun control measures that Obama is now proposing.
So while Obama is on slippery (and likely illegal) ground when his executive orders face judicial review and court challenges, it doesn’t look like the Republican presidential field plans to take any chances.
Florida Sen. Marco Rubio said that on his first day in the Oval Office, “those orders are gone.” Texas Sen. Ted Cruz said that while Obama may currently hold the power of the pen, “my pen has got an eraser.”

As a legal gun owner who despises Obama, I think doing better background checks are a good idea. It help weed out the people who shouldn’t own a weapon. When I applied for my permit, it took almost 10 months to get it. When I went to purchase a gun I had to wait 2 weeks before I actually took possession of my new gun. It was a very long time but if everyone had to do a background check, less violent offenders will have the opportunity to buy a gun. Other than that, he needs to leave the legal gun owners alone.

Really when is the last time you tried to buy a gun. There are four-page forms that have to be filled out already. People have to leave their most personal information sitting in stores with their social security numbers and home addresses left of them. Then there is a background check made right there and then using their drivers licenses. Then there is a three-day waiting period. If Huessin Obama was so worried about our safety he would be closing our borders and re-opening mental facilities. Instead all he is doing is helping his brotherhood like he promised. These new over the border people can apply for all of the above and look clean. All this will do is put guns in the hands terrorists and leave law-abiding people at more risk. The best way to end governing by executive order is for the next president to void every outstanding executive order on his first day in office. At the least, the next president could give Congress until the 200th day of his presidency to either pass legislation upholding a particular executive order or watch the order die on day 200. I chose 200th day because that gives the president 100 days to get Congress to act on his agenda and then 100 days to enact laws covering executive orders before they expire.
President Obama’s efforts at gun control have backfired. I suspect more people own firearms now than they did before his first failed attempt at gun control. The gun industry is likely to weep really loudly when he leaves office. He has done wonders for increasing gun sales in America. I would agree the Obama executive orders are likely to be overthrown in the court system.
So, if congress knows he is violating the constitution,,, why don’t they just have the sergeant at arms arrest him when he enters for the State of the Union address?? THEY CAN LEGALLY DO IT THERE!!

The real reason he did this is to prevent transfer of weapons for personal defense from one place to another, ( i.e. if and when the govt. goes for guns, in defense of our rights and our homes and our families.) The order doesn’t only apply to sales, but to gifts, trades and other transfers.
What this says is that he’s worried about an insurrection after he declares martial law. And he’s right to worry: there aren’t enough feds to take on an entire nation. He wants to bottleneck the transfer of arms in case there is a popular resistance. By the way, he’s too late for that: we’re already gunned-up, as the Governor of Texas has indicated.
This is another way to increase the power to the ATF – not just the FBI. The FBI isn’t worried about gun trading or small sales between individuals – but the ATF wants as much power as they can grab. They failed to cover themselves in Fast and Furious, and they’re spoiling for a battle – and a bigger budget. What better way than to make an Executive Ordure (spelling intentional) that gives them the right to break into your home at any time of the day or night?
The more they try to suppress the American public, the more heavy handed they get, the more resistance they’ll get. I propose a selloff of 60% of the ATF’s assets, firing nearly all of the top brass, and taking away their statutory authority over firearms entirely. Alcohol and tobacco? Fine. Let ’em deal with bootlegging of both of those.
He’s also trying to force gunowners to break the law when they purchase from friends or others who don’t have a license. This is a strategy to criminalize individual sales, to make it a federal offense (and a felony.) Once convicted, you lose your rights. The intent is to make felons of innocent, law-abiding Americans. Once the courts put a stay on the order, buy what you can from estate sales and other places. Buy in quantity, and duplicate any caliber you already have where you might have purchased a gun from an authorized dealer. Grab what you can during that period where the court has put a stay on the Executive Ordure.

By the way, one way to fight back – spread this far and wide – is to contact your Congresscritter and tell them that it’s unfair that the President gets tens of millions of dollars of vacation money, and isn’t taxed on it. The rest of us pay taxes on measly year end bonuses, while he gets to run around, spending OUR MONEY.
His vacations are taxable income. Make sure to tell everybody that you agree with Obumbler about class inequity: he gets, and we give. Time to make him stop confiscating our money for his own personal benefit!

It is obvious that a great many people don’t even read the article upon which they are commenting very carefully before jumping in to comment. A commenter asks: What law is he breaking? when the article itself very clearly and accurately described what law he is breaking. The Constitution (supreme law) very clearly provides for the separation of powers among the three branches of government. It is Congress that is provided the power of establishing laws; not the executive. And indeed the executive does have the ability and right to issue executive orders to facilitate their responsability and duty to administer and execute the legislation passed by congress. BUT, by very clear direction from the Supreme Court, execising its power to interpret the Constitution, it is very clear that an executive order cannot be legally/constitutionally used to actually establish law or thwart the legislative decisions of the Congress regarding the passage of such. The latter has failed/refused to pass proposed legislation which would provide for doing what the Executive is now trying to assert by Executive Order. So whether you may agree with the action or not POTUS is exceeding his Constitutional authority and thus,,,”breaking the law”.

EXECUTIVE POWER
We hear over and over again the phrase by President Obama that he is legally issuing executive orders, and so far I have not heard from either congress or the Supreme Court on the basis for his claim of the right to issues such order unless they meet the executive power purpose and dictionary meaning. The following is what the dictionary says about this power:
“concerned with, or relating to, THE PUTTING INTO EFFECT OF ORDERS, PLANS
OR POLICIES, executive power”
There is absolutely nowhere in that definition that says an executive has power or authority to issue any orders, create his own plans and policies and put them into effect.
You can go all the way through the listed powers and you will find that he must have authority from congress (even if acting as Commander in Chief) with only a few exceptions and they are clearly listed. They are: 1. Require in writing opinions of the principle officer in their respecting executive offices. 2. Grant reprieves and pardons for offenses against the United States—except in impeachment cases. 3. Appointment of inferior officers and others if authorized by congress. 4. Fill vacancies during recess of the senate for an unexpired term. 5. Receive ambassadors, etc. Note that it limits him to receiving which does not include negotiating with them without permission and guidance from congress.
He may from time to time give a state of the union to congress and RECOMMEND for their consideration to congress of such measures necessary and expedient and, call for special sessions of congress and adjourn them if he deems it necessary.
The listing of his powers and duties are summed up in the last paragraph of Article II, Section 3 of the constitution where it says, “he shall take care that the laws be faithfully executed and commission the officers of the United States.” Note that it says laws be faithfully executed. No place does it say that he can make the laws he is obligated to execute. And in the last paragraph of Article I, Section 1 it requires him to take an oath to preserve, protect and defend the constitution of the United States.
I do not think it takes a legal scholar to realize that his job is limited to putting into effect orders, plans and policies outlined by congress and it gives him zero authority to thumb his nose at both congress and the supreme court by ordering his own plans or policies into effect.
The crowning part of this argument lies in the wording of Article I, Section 8 where it says, speaking of congress,: “To make all laws which shall be necessary and proper for carrying into execution of the fore going powers, AND ALL OTHER POWERS VESTED BY THIS CONSTITUTION….. Which means clearly and simply that they have the power and authority to demand that the president execute the orders, plans or policies they create, and that he has no law making powers of his own.

We have had a State of Domestic Emergency since late September. That is, September of 2001. It has never been rescinded, though it was supposed to be reviewed every 6 months by Congress, which has not been the case.

Ollie North and his cabal attempted the same thing under Louis Guiffrida (sp?) of FEMA infamy in the REX 84 debacle. (Used to be a fair description of REX 84 in Wikipedia, until the govt. spooks rewrote it to their own satisfaction.) North hasn’t the courage nor the patriotism to admit what he did, and how much danger we’re in under a radical Leftist/Islamic Presiduncy. One word, and the Constitution is gone. Poof.
Continuity of Government statutes were designed in case of a Soviet first strike, in case there was no functional government. Dubya alluded to this a time or two, particularly to get his way on certain issues (such as the Patriot Act.) He maintained that he had the power, because of 9/11, to utilize these statutes – but chose not to. He used the threat to his advantage on several occasions.
Presidunce Obumbler has done the same thing. The threat is real, and it has been made. It would result in civil war, of course, but that’s a threat in itself. Presidunce Obumbler has insisted that he negotiates in good faith, because he could, like Bush, use these particular Executive Ordures (spelling intentional) at the drop of a hat.
Hopefully, Congress has a back-alley plan. That’s because the statutes make it impossible for Congress to even bring the topic up, once the statutes are enacted, for 6 months. What is needed is a review of these types of statutes, and under what circumstances they may be employed.
Prior to his taking office, I predicted that Obumbler would use PEOs (Presidential Executive Ordure) to achieve what he wanted
