Alabama may be rocketing toward a confrontation with the U.S. Supreme Court after a state judge seemingly threw the brakes on gay marriage.
Controversial Alabama Chief Justice Roy Moore on Wednesday said state probate judges remain under a court order to refuse marriage licenses to gay couples even though a U.S. Supreme Court decision effectively legalized same-sex marriage more than six months ago.
The outspoken chief justice, who previously tried to block gay marriage from coming to the Deep South state, issued an administrative order saying the Alabama Supreme Court never lifted a March directive to probate judges to refuse licenses to gay couples.
“Until further decision by the Alabama Supreme Court, the existing orders … that Alabama probate judges have a ministerial duty not to issue any marriage license contrary to the Alabama Sanctity of Marriage Amendment or the Alabama Marriage Protection Act remain in full force and effect,” Moore wrote.
The chief justice stopped just short of directly ordering judges to refuse the licenses. He wrote in his order that he was not “at liberty to provide any guidance to Alabama probate judges on the effect of (the Supreme Court ruling) on the existing orders of the Alabama Supreme Court.”
Nonetheless, at least three Alabama counties suspended all marriage license operations — not issuing licenses to anyone— as a result of his order.
The state Supreme Court issued its directive to refuse licenses to gay couples at the request of a conservative group after a federal judge ruled in January 2015 that the state’s gay-marriage ban was illegal. Months later, in June, the U.S. Supreme Court issued a ruling that effectively legalized gay marriage nationwide.
The state court had asked for briefs on how to proceed after the U.S. high court ruling, but never issued any follow-up orders. Moore said he was issuing his latest administrative order on Wednesday because there was “confusion” among probate judges on how to proceed. s.
Susan Watson, director of the ACLU of Alabama, predicted that Moore’s order would have little effect. Watson noted that the same federal judge who initially overturned Alabama’s gay marriage ban also issued an injunction prohibiting probate judges from enforcing the ban.
Most judges in Alabama’s 67 counties are issuing marriage licenses to gay couples, although at least three Alabama counties suspended all marriage license operations Wednesday in response to Moore’s order. That is in addition to the judges in nine counties who had already shut down their operations following the U.S. Supreme Court decision.
One of those who took action Wednesday was Mobile County Probate Judge Don Davis, who said in a statement that he had closed the marriage license office to “ensure full compliance with all court rulings.”
Alabama Rep. Patricia Todd, D-Birmingham, the only openly gay member of the Alabama Legislature, said it is time for Moore to stop fighting the ruling of the U.S. Supreme Court.
“He’ll be challenged and he’ll lose and he’ll cost the state a lot of money in the process,” Todd said.
Moore has become one of the state’s most outspoken opponents of gay marriage, and he has won praise from some conservative groups for his position that states should continue to try to fight the U.S. Supreme Court over the issue. In his order Wednesday, he wrote that it was “yet to be determined” if the state Supreme Court would agree with judges who have suggested that the U.S. Supreme Court decision is up for interpretation.

Do you remember an Alabama governor who tried to block a young black woman from entering the University? At least Gov. Wallace changed in later life and was reconciled with that woman. Now we have an Alabama Supreme Court judge telling people they don’t have to obey the law. In both cases the federal government has to intervene to protect people’s civil rights. Maybe such intervention won’t be necessary when bigotry doesn’t guide public policy.

You have failed to make a case on two points here. First the constitution prohibits the federal government from being involved in issues dealing with marriage among many other issues. The constitution provides specific guidelines for what the federal government in responsible for and states that ALL other issues are left up to the states. The supreme court can not decree that anything to do with marriage is a federal issue and thus “make new law”. They are there to interpret the law according to the constitution and they violated that by this decision. Thus the federal so called legalization of marriage is null and void on it’s face. Secondly, it being up to the states to manage issues of marriage then the Alabama state statute is the governing principle to which all are subject to. No marriage licenses that are issued to gay couple are legal in Alabama as a result. It seems as though all you liberals continue to go by the Obama rule of governing. This is, if I don’t like it then I will change it. Except neither Obama or the SC have the authority to change anything to do with marriage in any of the states per the constitution of these United States. I don’t care how much crying, sobbing, whining, bleeding heart stories, or any other BS you try to shovel down our throats. It don’t amount to a hill of beans. Which is to set a bill in motion to change their constitution and then follow that process as dictated by their state law as to how to make that change happen. Change, apart from constitutional law is lawlessness. That definition applies not only to the U.S. Constitution governing the affairs of this nation, but the constitutional makeup of the human race. No one is conceived or born of a homosexual union. Therefore, gay marriage is not a civil issue. The term “civil” concerns community life as distinguished from the military, criminal, ecclesiastical, or international proceedings. The community is comprised of biological parents to every human being, and rightfully sustained, those parents are the backbone of the home for the nurture and sustenance of their offspring.
By constitutional makeup, we mean the system of fundamental laws and principles that prescribe the nature, functions, and limits of our physiological being. Male and female are differentiated for very specific functions, and it is only the perversion of these principles that make claim to a “civil right” for personal pleasure. Sure, we challenge the law of gravity, but only short-term, and at very great cost. We depend upon the law of gravity for the orderly operation of all universal bodies. Without these set laws, chaos and destruction would soon follow. And that is precisely what is happening within each society that encourages and accommodates license without restraint. Just ponder the depth of this stated truth, and look at the evidence in societies around the globe that defy the principles of constitutional order.

Since the beginning of the Republic. State legislatures may pass laws but our Constitution assigns to the US Supreme Court the responsibility and power to affirm or invalidate such laws.

Gods question. The Supreme Court of the United States can only interpret what is in front of them NOT make it so. The states have the right to accept the interpretation or not.

I’m not sure if Judge Moore has more to his plan than what is listed in the story. If not, it appears that this is going to do nothing more than cost the taxpayers of Alabama a lot of money in legal fees.
I disagree with the Supreme Court decision. They got it wrong. According to the 10th amendment to the Constitution, states are responsible for all aspects of government not specifically granted to the federal government by the Constitution. Each state sets its own rules regarding marriage. For example, some states allow common law marriages.
I think the Supreme Court decision violates the rights granted to the states by the Constitution. I’m not sure what avenue exists to negate their ruling short of amending the U.S. Constitution, which probably wouldn’t make any difference since Washington has a way of ignoring the governing document anyways.

The nation tried once before to take away the right to say yes or no to personal decisions. Prohibition. This spawned the gangster boot legging era, in Chicago no less. SSM takes away the right of states and individuals to say no to the personal decision to get married, if asked by homosexuals to marry them. This also smacks of the Jim Crow and separate but equal schools in the south. Why are only homosexuals given the right to get married? All non-homosexuals are being discriminated against. The use of “rights” has turned into patronage politics, which the dimocrats are good at since it was the dims that used Jim Crow to give whites various legal patronage hand outs in the south. And the most recent patronage racial assault by the dimocrats has been the confederate flag episode in SC etc. And statues in various places. This smacks of the muslim destruction of the 700 year old statues in Afganistan for religious reasons. There are other things, streets, colleges, and no telling what else that have names related to the Civil War that have not been purged by the democrats under the leadership of BO. And there seems to be separate civil right violation attacks on white police officers when a black is killed by an officer. And despite the fact that all police depts. suspend officers and investigate shootings by any officer. To all police depts. black lives matter since the police do not engage in drive by shootings. And Chinese and Hispanic and all lives matter for all police depts. It seems the real trouble is the Dept of Justice for focusing on matters that are not within their scope. The DOJ should be investigated to see if they are violating the civil rights of citizens. It is also apparent that govt employee lives in Benghazi don’t matter to someone(s)? Another thing the party of blame is good at is always trying to justify what they are doing by blaming others. There are millions of guns owned by millions of people in America and the fraction of people that use guns for illegal and immoral purposes is an insignificant percentage of gun owners. Less then 1 %. The next thing to be tampered with by this admin will be cars. After all cars kill people like guns kill people and they are all registered. They will want to put governors on cars using the standard heavy handed approach this admin is fond of. Personally I feel, and not from a religious point that people who are gay, bisexual, or lesbian are mixed up. If one believes in reincarnation I would think these people are carrying into this life an influence from a previous one in which they were of the opposite:be it man or woman. Everyone comes into this life to learn from their experiences and obviously they have theirs. I have an adverse feeling to this for me and my lifestyle. However I feel they have a right to be mixed up if they want to be. As long as they harm no other and pay their way and are not a burden to others why not let them be. They have as much right to live their live style as I do mine. I don’t think that same sex marriages should be considered in the same sense as the marriage between a man and woman. That’s ridiculous. It just isn’t. Let’s see if legally we can set up over our whole nation and all our states a legal “union” for these people. One that can be accepted and beneficial for everyone. A person’s sexual orientation, is NOT a civil right. This issue is not about a person’s right to marry who they choose. Where do you draw the line??? …..what about a Father who wants to marry his daughter? A woman in love with her brother?isister…..How can it be unlawful for Men to have multiple wives? Each state should be able to govern itself.
The governors of states should have the right to issue executive orders effecting their states, if Obama has the right to issue executive orders effecting the government. Governors are responsible for what takes place in their states, and are more aware of what is best for their citizens, and those that voted for them. Obama should keep his nose out of state business instead of thumbing it at everyone.
