As if the devastating blow delivered to pro-lifers by the Supreme Court yesterday wasn’t bad enough, a federal judge — an appointee of President Barack Obama — has just dealt Christians another slap in the face.
And there’s likely more to come.
Mississippi clerks cannot cite their own religious beliefs to recuse themselves from issuing marriage licenses to same-sex couples, under a ruling a federal judge handed down Monday.
The effect of the ruling by U.S. District Judge Carlton Reeves is that the state can’t enforce part of a religious objections bill that was supposed to become law Friday.
Reeves is extending his previous order that overturned Mississippi’s ban on same-sex marriage, and said circuit clerks cannot excuse themselves based on their religious objections from issuing these gay marriage licenses. He also said that all 82 circuit clerks must be given formal notice of that requirement.
Mississippi’s religious objections measure, House Bill 1523 , was filed in response to last summer’s U.S. Supreme Court ruling that legalized gay marriage nationwide. That ruling is called the Obergefell case, after the man who filed it.
“Mississippi’s elected officials may disagree with Obergefell, of course, and may express that disagreement as they see fit — by advocating for a constitutional amendment to overturn the decision, for example,” Reeves wrote Monday. “But the marriage license issue will not be adjudicated anew after every legislative session.”
Attorneys were still waiting on rulings from Reeves in two other lawsuits that seek to block all of the religious objections law, including provisions that could affect schools’ bathroom policies for transgender students.
Attorneys for Republican Gov. Phil Bryant and Democratic Attorney General Jim Hood have defended House Bill 1523 in court.
“Our attorneys received the order late this afternoon and are reviewing it,” Bryant spokesman Clay Chandler said Monday.
Republican Lt. Gov. Tate Reeves criticized the decision of Judge Reeves, who is no relation.
“If this opinion by the federal court denies even one Mississippian of their fundamental right to practice their religion, then all Mississippians are denied their 1st Amendment rights,” Tate Reeves said in a statement. “I hope the state’s attorneys will quickly appeal this decision to the 5th Circuit to protect the deeply held religious beliefs of all Mississippians.”

Why is it that the “Christian” right can’t understand that while they have, and certainly should have, the right to conduct their personal lives in a manner consistent with their religious beliefs they should not have the right to impose those beliefs on everyone else. They do not have to have an abortion. They do not have to enter into a same sex marriage. By trying to force others to follow their beliefs do they believe that guarantees a better seat in heaven’s stadium? I think not.

I don’t support gay marriage, but the judge has a point. The clerks are government employees. If they are hired to grant marriage licenses they need to do so. I don’t think any of us wants a government bureaucrat looking at a couple (gay or straight) and deciding whether they should be granted a license. If a couple meets the standards to get a marriage license they need to be issued the license.
Sometimes it helps to look at the issue in a different light. If I had a Muslim mail carrier I would expect him to deliver my Christmas cards with the rest of my mail. Doing his job would not mean that he approved of or endorsed Christianity or Christmas. Delivering the card would mean that he is doing the job he is being paid to do. I would not consider it an acceptable substitute to have to drive to the Post Office and wait in line to get my Christmas cards. The clerks are government employees. If they don’t want to do the work their employer calls on them to do they need to find another job.
I agree with you 100%… But I neither support, nor discourage gay marriage. I am a straight white female, so committing myself to a relationship that includes any from of sexual intercourse simply WILL NOT happen with me. However, I perfectly understand that people love who they love and it’s not out right to bar anyone from choosing to commit to the person they have fallen in love with in any manner they see fit. Marriage is not about pro-creation, for many people marry who either can’t or will never have children born from that union. Rather, it is a bond between two people. Whether recognised by law or not, that bond will still exist. There are just some things we can not make laws to control… If a person is employed and insurance is offered to cover that person’s significant other, who are we go deny them the right to cover that person just because they happen to have the same reproductive organs? As long as the premium, co-payments, etc. are paid, what business is it of ours?… I know this sounds like I support gay marriage but all I am saying that the law recognising the union is the only way insurance companies will cover their chosen life partner. I’m sure there’s a much deeper reason why gays want to marry but, to me, that reason is the strongest one I can think of for the law to substantiate it.
I vary nearly agree with you (I happen to think marriage is a “procreative contract,” even if the couple turns out to be emotionally uninterested or medically incapable of procreating). I think a good chunk of this fighting could be diffused if the government recognized a legal union that wasn’t called “marriage.” (As a Libertarian, I don’t think Government should be in the business of issuing marriage licenses in the first place, but I suppose there has to be some kind of record so the IRS knows who can file jointly and probate knows who is and isn’t “next of kin”)
