Barack Obama’s health care law is, in many ways, the keystone to the presidential legacy he cares so deeply about.
Yesterday, a federal judge took a legal sledge hammer to the law — and it could destroy it for good.
A federal judge ruled Thursday that the Obama administration is unconstitutionally spending federal money to fund the measure without approval from Congress.
The ruling from U.S. District Judge Rosemary Collyer was a win for House Republicans who brought the politically charged legal challenge in an effort to undermine the law.
If the decision is upheld, it could send the health care law’s insurance markets — which are still struggling for stability after three years — into a death spiral.
Collyer said her ruling would be put on hold while it is appealed.
According a The Associated Press report, at issue is the $175 billion the government is paying to reimburse health insurers over a decade to reduce co-payments for lower-income people.
The House argues that Congress never specifically appropriated that money and has denied an administration request for it. It says the administration is spending the money anyway, exceeding its constitutional authority. The administration has said it can spend the money automatically because the law authorizes it.
House Republicans launched the lawsuit in 2014 over Democrats’ objections. The House had already voted dozens of times to repeal all or parts of the law Republicans call “Obamacare,” but those efforts went nowhere as they stalled in the Senate or faced a White House veto.
Instead, the House turned its focus to tying up money spent on the law. Republican House leaders asserted that the Obama administration couldn’t spend money that lawmakers refused to provide.
House Judiciary Committee Chairman Bob Goodlatte, R-Va., called the ruling “an important step toward restoring the separation of powers and stopping President Obama’s power grab.”
“The Constitution is also clear that Congress has the power of the purse. The president cannot spend Americans’ money on his own terms,” Goodlatte said.
The disputed subsidies help lower-earning people afford out-of-pocket costs such as annual insurance deductibles and co-payments when they visit doctors.
These subsidies, called “cost-sharing reductions” are separate from the financial aid provided under the law to help people pay their monthly premiums, which would not be affected. But that doesn’t make the cost-sharing subsidies any less important. Without them, millions of people may not be able to afford to use the health insurance that they have obtained through the law.
Under the law, insurers have to provide cost-sharing assistance to consumers who earn up to two-and-a-half times the federal poverty level, or $60,750 for a family of four.
The government is then required to reimburse insurers for the cost of the subsidies. The administration maintains that the law authorizes the government to provide the money automatically, without going back to Congress for approval each year.
But Collyer rejected that argument, saying appropriating the money is up to lawmakers. “That is Congress’ prerogative,” Collyer wrote. “The court cannot override it by rewriting” the law. Collyer was appointed to the court by President George W. Bush, a Republican.
If Congressional approval for the spending is required, Congress’ GOP majority can just shut it off. And if that happens, the administration says the only option insurers have would be to raise insurance premiums significantly.
However, companies might also decide to bail out of the health law markets altogether. Major insurers already are struggling to make money on the program.
The White House had earlier argued that the House had no legal authority to pursue its lawsuit, but Collyer rejected that argument and allowed it to proceed.
Former House Speaker John Boehner, who authorized the lawsuit, tweeted that the decision “is a victory for the American people, and for House Republicans, who have stood firm for the rule of law.”
The administration is expected to appeal Thursday’s ruling to the U.S. Court of Appeals for the District of Columbia Circuit.
In another case last year, the Supreme Court threw out a challenge to the law’s subsidies for premiums. However, the legal issues in that case were much different.

This case is not really that significant for the ACA. The judge said that Congress had authorized the subsidies for the deductibles of low income patients, but the funds were not formally appropriated. The tax credits for the low income are not affected and under the law those credits will increase if the subsidies are not implemented. Beyond that, since the subsidies were authorized (as the House Republicans admit), if insurance companies end up paying any more, they have a claim against the government that will probably not be opposed by anyone. These things will probably be disruptive to everyone involved with the system, but make no difference in the long run.
The possibly meaningful part of the judge’s ruling happened months ago when she ruled that the Republicans had standing to sue to begin with. That is counter to centuries of law saying that such disputes are not properly the subject of litigation.
A court’s interpretation of the disputed law will normally and properly come when someone who is injured by the appropriation, or lack of appropriation, brings an action. It is unlikely that this ruling will be upheld when it is appealed to the DC Circuit.
You have to be a lawyer. They complicate everything. Just condense it down to a simple balance of powers between Executive Legislative and Judicial branches and Obama has circumvented his executive powers by using executive orders to exceed the executive branch’s power. However, you seem to be so caught up in anti-Obama rhetoric that you are misconstruing what is happening here. It is the federal court that has exceeded its power at this moment, and that is why the appellate court is probably not going to permit this judge’s opinion to stand.

First, show me the word “health” in the Constitution ANYWHERE, much less as it applies to any individual American.
Second, show me even the IDEA that General Government actors can order ANY American to purchase ANYthing from ANYONE at ANY time for ANY reason!
Since neither of the above are in there, that’s what i had hoped was the basis for the court’s ruling, not the funding thing.
On top of all that, when SCOTUS alleged ruled that D’OweBamacare was “legal as a tax”? Most Constitutionally-illiterate Americans do not know that ALL “bills for revenue”(aka “taxes”) MUST originate in the House. D’OweBamaCare originated in the Senate.

Some of you may wish to cut’n’paste the foregoing citations – or at least remember that any “law,” any “agency,” any “Department” which can point to no legitimate part of the Constitution to justify it’s existence is Unconstitutional, and not only should not be obeyed, but should be actively resisted.
After all, prior to the Civil War, escaped slaves were supposed to be returned to their owners – and it was written in the Constitution! However, Northern juries refused to convict anyone brought up on these charges – for once upon a time, it was well-known that juries can rule on both the facts AND the law itself, whether they felt it just and right…and completely ignore the judge’s “instructions,” for the Jury was the last lawful check of the People against overweening or tyrannical gov’t agents. Now, judges routinely slap down attorneys who even ATTEMPT to inform juries of the power they have, and most of these sheeple just obey the judge – apparently not realizing that they are HIS master, not the reverse!

Jury nullification, which you mention here, is becoming a more important issue in the US (see http://www.juryduty.org/ and http://ralstoncreekreview.com/chapter-38-outside-the-law/). I think we may see more of this in the future.

To me, REAL education starts with studying the Constitution, as well as learning about not only your Rights, but your Duties, and how to exercise both. That could begin by reading, understanding, and applying the principles of the Constitution to hold ALL office-holders to account for their Oaths of Office – that is, when ANY public employee or public servant violates that oath, they are to be swiftly ARRESTED and tried for Felony Perjury – for LYING under oath, their oath of office.
Had this practice been routine, say from 1840 to 1913, gov’t agents would have remained afraid of the People, and there would have been Liberty; as it IS, they are NOT afraid, and we have TYRANNY.
It is my sincere hope that Americans educate themselves about the power they can wield as jurors, and routinely REFUSE TO CONVICT ANYONE CHARGED WITH ANY “CRIME” where there is no damage to any living man, woman or child, in their lives, liberties, or properties.
Busted drunk driving after falling asleep at the wheel? Where’s the injured party? What? No injured party? We the Jury find the defendant not guilty.
i’ve often felt that if “the State” charged me with something, i could inform the judge and the prosecuting attorney that i’d be calling “the state” to the witness stand, and if they could not produce it so it could be cross-examined, the case should be dismissed for violation of Due Process, and the 5th Amendment Right THEY guaranteed to me via the 5th Amendment they swore to uphold, that i would NOT be denied the power to cross-examine any and all witnesses against me.

Do not get this wrong wrong because I believe Obama is the lowest form of life. With that said, neither democrat nor REPUBLICAN elected career politicians seem to care about the high cost of insurance. I am disabilied veteran so I GO to VA (with some reservation) for my healthcare but my wife was without insurance for 10 years and was almost blind before obamacare kicked in. Now she can see. Her premium doubled from last year but WE at least have something. I am at least glad somebody got off their but and did SOMETHING… That is why I am voting for DONALD TRUMP. HE MAY DO AWAY WITH obama are, but he I believe will have something to replace.

This has put such a strain on my Loved ones with this ovamit care. My daughter who is a single mother has to pay her
premiums, and she is not even eligible for health insurance. Companies are covering there a@$%ess so they do not
get penalized. I know alot of people are sick and tired of his time in office. How he made it I don’t know. No I do know
the 13 who call the shots. Oh did you know that mooslims do not have to pay anything for there insurance. It’s
gambling to them. Yet they abuse the system, and get want they want because of the mooslim himself. I can’t for the
life of me believe he is still in office. He doesn’t abide by our constitution our laws. He makes his own. They have made
a mockery of the WH. Abuse us taxpayers going on trips that do us no favors. He needs to be arrested. He won’t resign.
