President-elect Donald Trump says he’s ready to move on and let former Secretary of State Hillary Clinton walk.
But she might not get off that easily!
One leading expert says the Department of Justice has more than enough evidence to lock her up – and he’s saying the time to indict her is NOW.
Fox News Channel’s senior judicial analyst, Judge Andrew Napolitano, said on Monday the FBI has collected enough to prosecute Clinton on one of the most serious charges of all: espionage.
Napolitano said the evidence the FBI has could be used to make a case for “failure to safeguard state secrets,” and that’s only the charges she would face for her private email server, which experts believe could have been penetrated by foreign hackers.
Napolitano admits he was concerned when Trump said he was willing to let Clinton slide.
“I don’t think the decision to prosecute or not to prosecute should be a political one,” he said. “It should be a legal one.”
That legal case is still growing as Clinton reportedly faces at least two other investigations: a public corruption case involving pay-for-play allegations from her time as secretary of state… and a probe into the shady activities of the family’s charity.
“Was it a bona fide charity? Was it a slush fund?” Napolitano wondered aloud. “Was it a criminal enterprise in which the money did not go as the donors intended it to go?”
The former New Jersey Superior Court judge also warned President Barack Obama that offering Clinton an escape route via a presidential pardon would “leave dangling a lot of gross inconsistencies.”
Gen. David Patreus, for example, was forced out of a distinguished career for allegedly sharing classified information with his mistress, who was working on his biography.
“He would have to pardon about half a dozen people in order to put Mrs. Clinton into perspective,” Napolitano said.
That seems unlikely, especially with Patreus now in line for a possible major role in the Trump Administration.
And that means Clinton could ultimately be prosecuted – and given her age, a tough sentence if convicted could essentially put her away for life.
At least one Trump insider believes there’s still a chance it could happen.
“He said he wouldn’t rule it out,” campaign manager Kellyanne Conway told CNN. “He said it’s just not his focus right now.”

The law does not turn on “comparative guilt”. I’m ex-military, and believe that Petreus is exactly where he belongs, for what he has been proven to have done.

Perhaps Trump is making a ‘silent’ statement here that not everyone ‘gets’. He, personally, may not pursue Hillary, etc. once in office. I believe I read that, as President, there are restrictions concerning that. It could be considered a ‘personal vendetta’. That is forbidden ‘legally’ for his office. On the other hand, he ‘can’ quietly ‘allow’ further ‘investigations’ to go on through various offices like the FBI, CIA, etc. etc. That way, it becomes a ‘legal’ matter and not a ‘political’ one. If there is enough evidence to prosecute Hilary they need to do so. Trump does not need to be a factor of that decision and would be better to allow the justice department do their job without any push from him. I am not a legal expert. When a president is considering to pardon HRC, it seems illogical because you can’t pardon a person who has not been convicted as yet. The person is pardon only after he or she was found guilty. This is the way what I understand. I don’t know if there are some other perspectives that I am not aware of.

Many military people have been executed for simply being too tired to stay awake and falling asleep while on guard duty even if nothing bad happened. Christopher Gregory, I don’t think that you’re understanding one of the key details here. President-elect Trump is not President Trump until he has taken the oath of office and been sworn in. That is when he becomes our President. He does not yet have the authority to do what you think he should do. Also, His will be an officer of the executive branch of government. The issues involving indictments are under the authority of the judicial branch of government. So even when he becomes President Trump on Jan 8th, it will still be the judicial branch which any indictment would have to come from. I’m sure that he is staying on top of the opinions of those being considered for Attorney General or head of the Dept of Justice or head of the FBI. They are the ones who must decide if there is sufficient evidence to indict any person. Part of that is deciding if there is enough evidence that is stronger than just circumstantial, which it would have to have to get a conviction of any meaningfully severe enough charges to ensure conviction would result in incarceration. But what all of the people commenting need to realize is that based upon our constitution, the President’s role in the executive branch limits what he can personally get involved with legally, with the judicial branch. He can, I believe, suggest or request an investigation be undertaken, but those results would be the responsibility of the judicial branch personnel to decide whether the evidence merits a trial, and what they decide to try a person for, what the charges are, will determine the latitude that could be given upon sentencing. I’m pretty sure Mr. Trump’s recent cooling on arresting or trying Hillary or any of the others who were involved, has to do with the Constitutional limits, the restraints, that will be incumbent of him to abide by, once he has been sworn in.

Pres. Elect Trump’s statement was correct and statesman-like. It removed the political retribution aspect of future investigations of Hillary & Clinton Foundation. This returns the Justice Department and FBI to a legal only – justice only level of operation and opens the door for proper and correct investigations based on LAW and JUSTICE. In that view – Hillary and Clinton Foundation will collapse under their own corruption. This may trigger a special investigator – but the result will be the same. I got a death threat from a Trumper last night for the crime of being a Democrat, and today I’ve seen more than a dozen conversations talking about a second Civil War in the United States.
I wonder, what would a second civil war look like in this country? I have never been so afraid.
Can’t arrest her until obama can’t intercede or her behalf. Then we need to cut a deal for her info on obama.
We don’t need her info on Obama; Trump just needs to sign executive orders unsealing Obama’s currently sealed records.
Of course, by then, Obama will be living in a country that won’t extradite him, but at least he won’t be here poisoning America any more.
