A conservative strategist and ally of former President Donald Trump has suggested an avenue for Republican Party leaders to remove President Joe Biden from office.
Stephen Miller — Trump’s former speechwriter and senior advisor — appeared on Tucker Carlson Tonight a year ago to suggest invoking a provision of the U.S. Constitution to oust the 46th president.
In Article IV Section 4, the Constitution requires the president to protect each state “against Invasion.”
Miller argued for classifying the border crisis as an invasion… and therefore grounds to remove Biden.
Fox News host Tucker Carlson probed Miller about the Biden administration’s record of transporting asylum-seekers from the southern border, into the interior of the country.
“So, it is now beyond dispute that the Biden administration is moving very large numbers of foreign nationals who are here illegally into the interior of the country without the consent of the neighborhoods into which they are resettling them,” Carlson observed. “Is that legal?”
“No, it is absolutely not legal,” Miller stated. “It violates a wide series of immigration laws that delineate in great depth the precise rules and conditions for how you can enter the country and how you cannot enter the country. That’s why in fact my organization, America First Legal just argued alongside Texas in Federal Court that these policies must be enjoined.”
“So, there’s very little — I mean, you have an organization that is using the law to try and stop this. It is happening in real time, it’s been happening for six months without the knowledge of the 320 million American citizens whose country this is, but there is someone who can stop it and that’s Greg Abbott who is the Governor of Texas, who commands the Texas National Guard, and of course it’s his border over which a lot of these people are coming,” Carlson responded.
“Why wouldn’t he shut the border tonight with Mexico and stop this?” he asked.
“Well, I would argue that the appropriate constitutional remedy is Article IV Section 4, which says that the government clearly has the obligation to protect any state in this country against invasion and domestic violence,” Miller responded.
“It does not say that that has to be in the form of a nation-state actor. In other words, the Constitution doesn’t say it has to be a state-led invasion. It is any large-scale unwelcome uninvited entry into a country that ordered to a state, that would provide the constitutional predicate for exactly what you’re describing,” Miller concluded. “I’ll also add this, if that’s not an impeachable offense, I can’t imagine what would be.”
Miller wants to impeach Biden for falling to stop a tsunami of asylum seekers and illegal immigrants.
Now that the Biden administration is preparing for the expiration of Title 42 — a Trump-era policy allowing Homeland Security cite the pandemic as a reason to refuse asylum-seekers — Miller’s suggestion is even more relevant.
Even before the end of Title 42, judges have already used the word “invasion” to describe the humanitarian crisis at our border. Those judges include an elected Democrat in Texas.
Besides Miller, other Republican strategists have suggested invoking the 25th Amendment to remove Biden. However, no one has invoked the Amendment before.
