Crazy liberals are at it again, and this time they are attacking a Blue Star Marine family.
Heather Valenti moved to Oceanside, California with her husband, a U.S. Marine, in April after he was transferred to Camp Pendleton in Southern California. He was then deployed overseas, and in support of his service she displayed a small American flag outside her home.
What happened next is truly disgusting.
Valenti was contacted by her Homeowners Association, who demanded she take down the American flag, Fox5 San Diego reported.
The letter read, “During a recent property inspection a flag was noted in the Common Area landscaping at your unit, which is a violation of the Association CC&R’s. Page 6 of the Rules and Regulations states: ‘No property may be left or stored in the Common Area outside any residence.’ Please remove the flag from the Common Area landscaping immediately. Failure to comply will result in further action by the Board of Directors.”
The HOA is demanding a woman – whose husband is fighting for their freedom – to silence her display of public support for him.
And it gets even worse.
Valenti claims that other members of her neighborhood have displayed non-U.S. flags and signs in similar locations, with no threat of punishment from the HOA.
“I just feel like I’m being targeted,” she told local station Fox 5. “There are other people in the community that have other things up in the same exact spot and I haven’t seen them taken down; no consequences with that.”
For example, there is a flag with a pineapple on it in her neighborhood that has been no problem for the HOA.
Apparently, they are only offended by Old Glory.
Valenti’s husband is putting his life on the line, and his wife doesn’t even have the freedom to fly a small flag in his honor?
It’s another example of a senseless attack by liberals on American pride.

My husband put up a flag pole and attached old glory to it and it was flying high. Two days later I was looking at flag pole and there was a note on it saying take down this flag.you have no right to fly it. We did not take down the flag and it has been vanized offen. We had to buy a shorter pole as the men in our street knocked it down. Our flag is stll flying high. I served in the Navy for 30 years. Commanding Officer of two different submarines and a 600-foot long submarine repair tender. I have not been flying my flag upside down, but now that you bring it up , it would have been appropriate for what Obama has done to this country. Hopefully there are more people that are members of the homeowner’s association that support flying Old Glory then there are those that do not support flying the flag.. If that is the case, can you get them to support a change to the HOA’s by-laws to allow flying the flag of the USA. I imagine that when those by-laws were written, they were thinking about very anti-American flags being flow; But now there are so many people in this country that want to do it harm, we have these dirt bags that want to burn our flag. 8 years ago when Obuma got in office I got my husband to take down our flag in protest. After a couple of months he put it back up because he said we have to show support for our service members as we live in a military town.

As the article stated, “she displayed a small American flag outside her home”, not inside her residence as you stated. Thus the HOA can impose reasonable restrictions. But considering the size of the flag it seems the HOA exceeded it’s authority, likely for PC reasons, and thus violated federal law.
So all she needs to do is to send them a notice of the federal law allowing US flags being flown outside in communities governed by HOAs. If that fails she should get a Veterans association junkyard dog lawyer and take a bite out of someone’s hide.

Roberto Martinez, Homeowners Association rules are often better in maintaining a community, often built by a developer, than zoning rules. But at times HOAs become overbearing and discriminate illegally based on personal prejudices of board members. This seems to be the case here. That’s why I prefer living in communities not covered by HOA rules.

So the question is, what does “common area” of that particular HOA encompass? Is it everything on the outside of the homes? I think that’d be unreasonable.
Also, HOA rules MUST be enforced for all. Would a rainbow or UN flag have been allowed? If so that’s discrimination and illegal. What kind of people are the leaders of that Homeowner’s Association. Obviously anti-American. She should contact Liberty Counsel or American Center for Law and Justice (ACLJ) or the Rutherford Institute and have them file a suit to force an election of the HomeOwners Association and get different, pro-American people in charge.

The American flag can be displayed anywhere, anytime, according to the “Fly the Flag Protection Act” of 2005, including on the private property of residents in an HOA. Contact a lawyer and the local American Legion and VFW and they will help I’m sure.
I had the same issue when I moved into my HOA 8 years ago. Due top my persistence and principle I now have a 40′ free-standing flag pole in my yard with other small flags scattered in my yard.

I have two U.S. Flags flying and my HOA has not said anything about the American Flag, and they better not. We do have restrictions on flying flags. But the U.S. Flag and the State flag are exempt for that restriction.

As a person who lives very close to Oceanside, a military town, this comes as a surprise. This woman should take photos of other items being displayed in the common areas and present her case to the board of at the next HOA meeting. The Board needs to prove she is not being targeted. CC &R’s are to be enforced evenhandedly. If they are unwilling to send out notices to others with items in the common areas, they have a big problem on their hands.
The hell with that! Take the pictures, contact Judicial Watch or some such legal foundation, and let that legal team file a law suit on her behalf. Do not even try to negotiate with these heathens.
What most people don’t know is that “Old Glory,” as referred to in the article, is the WAR flag of the United States. Fewer still know that there is a US Civil Flag of PEACE. (google if interested) A MINISCULE number not only know about it, but FLY it…and most who see it have NO idea what it is.

What you have are Constitutionally-SECURED rights, but these are only as good as the honor and integrity of those who swear under oath to “preserve, protect, and defend(it) against all enemies, foreign and domestic.”
Neither you nor anyone else has “Constitutional rights.” Never have had. Never will. You may not realize it, but longstanding US law shows that you – and no individual American – is a party to the Constitution, as it’s a compact between the States and the general gov’t actors. Here’s what i mean:

The states were the entities that ratified the Constitution, but remember it was and is the citizens of the individual states who voted to either accept or reject the Constitution and its amendments. Therefore it is in fact the private citizen that is the party to the Constitution. Originally the states (and the federal government) only have the rights the private citizen chose to grant them. However over the course of time the liberals have contrived to make it appear the opposite of this where the federal government and/or states are the ones to give the private citizen their rights. We can thank the public school system (or should I call them what they have really become, indoctrination centers) for this sad state of affairs. We need to push back against the liberal (communist/socialist) agenda to turn the USA into a communist dictatorship.

i’m just telling you what IS. There are a LOT of things that SHOULD be, but aren’t.
No individual American had any say whatsoever in ratifying the Constitution for the United States(and even State representatives refused to do so without a Bill of Rights attached). ONLY State representatives had any say in ratifying the Supreme Law of the Land, and then only in their official capacity.
This is why most lawsuits against D’OweBama failed, for “lack of standing.” If you are not party to the Constitution, you CANNOT SUE on the grounds of a breach of it. ONLY State reps can do so. Too late to pressure State reps to do so now, and most were afraid of D’OweBama’s power as well as the political repercussions from those who would hate on those who opposed the “first black president,” so were unresponsive to the (unfortunately small) public outcry against that Unconstitutional usurper.
MAYBE Trump will go after him with all the resources available to the president of the Executive Branch(which includes all the alphabet agencies, including the NSA etc.), and D’OweBama can go down in history as the first – and hopefully, last – imposter who illegally assumed the office and the first imprisoned post-officeholding.

If I am going to buy a house, a home owner association is a deal killer for me. If I am paying my money for title, it is going to be fee simple, or I ain’t interested in buying. Absolutely disgusting – no doubt ardent supporters of O’bozo the “Big Eared” Clown – we have a Grandson serving in the Marine Corp. and I have installed a flag pole in our front yard and proudly fly the flag every day and would love for someone to approach me or attempt to do something to my flag. They would immediately meet with some very stiff resistance and suffer as a result. While the Supreme Court ruled it’s a covered act to desecrate Old Glory those us who have served and have loved ones serving feel differently – if you don’t agree with what our flag stands for “get the hell out of here”.

I am a 74 year old Marine and live in Escondido, California. That is 30 minutes east of Oceanside, where I lived prior to moving to the HOA in Escondido. I fly my flag every day on the front of my “manufactured home”. Not all Californians are liberal. I go back and forth to the Oceanside VA for some of my medical services. The only problem with California is that Conservatives are in the minority here. Lib areas like LA, Santa Barbra, the Bay Area, and Sacramento, have the population numbers to control the state and you folks only hear one side of our story; The Liberal Bad Side! That does not mean that the entire state is like that. We just need more Conservatives. God Bless America! Gare
This is just one of many reasons I will never move to any residence that requires membership in a HOA. It seems that a lot of the HOA’s start out with some common sense in the rules rules but after a while the liberals take over and the rules become nothing but communist type rules Where a few idiots attempt to dictate to the majority of property owners.

I’m sorry everyone, but the only way they could get the flag removed on my property is to dig it out of my cold dead hand, …, they better hope there isn’t any life in the other hand, because if there is, I will assure them that I’ll be signing their one way ticket to Hell for them, because I’ll shortly be sending them there! In the Marines we have a sayings that I really love to say; 1) “Kill them all and let Allah sort the bastards out. My 2nd favorite saying goes; 2) One shot (1), one (1) kill! Currently I’m flying only the Marine Corps Flag, it will be joined very soon with my “Old Glory”, which I love very much. I’ll say it like this, I have over 80% VA Disability from 2 combat tours of duty during my 6 years in “Old Mother Green, the Green Killing Machine”! I’m a Marine to the bone, my Blood Cells are green with U.S.M.C. stamped on each and every one of them. I make my wife and kids get up and shin all the brass every morning and salute the Flag. If they fail in their mission they can spend the night in my Brig! 🙂
Wow, a lot of emotions here, I get the board trying to maintain an appearance standard but it surely looks to be a double standard, as such, until they apply the conveniences guidelines evenly across the board, I would continue to fly the flag. Then apply some of the other suggestions noted above if you feel a legal defense is warranted. As a retired Captain in the Coast Guard, I support flying the flag but I also know when one moves into an area that does have restrictions we truly should try and abide by them.

I believe there is a Federal law on the books that exempts the US Flag from such restrictions. This and all other such HOAs need to be made painfully aware of that law. Hopefully, a Trump AG will do that!!

Semper Fi brother! I too, enlisted in the USMC. in 72. We Vietnam Vet’s who weren’t in country are overlooked alot. But I proudly served my country,in the capacity of my Nation’s discretion. Whatever they thought I could Best serve . I was trained To,& wanted to go in country, to do my responsibility to serve my country. As my two older brothers THAT had just returned from Nam. & Another one On the way ahead of me. All USMC. and one in the U.S. ARMY, he served in Germany . 5 total served in the Vietnam war era. But now, I’ve realized how Blessed I was, not to have faced what they had to face…but at 60 yr.s old ( my next B.D) I would still serve, if they called me to arms. I was a grunt. I have resided in a condo community that has several free standing houses since 1991. During that period of time we have had several Boards of Directors. Most of the members elected to the Board have been people with common sense BUT there have times when some of those who were elected to serve on the Board didn’t have the common sense to know when to “come in out of the rain” to coin an old saying. Then there were the “gung ho” group who loved to make life difficult in the community. Regardless of the Association documents it shouldn’t offend anyone to see their country’s flag flying.

One week I was a good teacher and the next week he told me he would recommend that I would be dismissed at the end of the year. I left him at mid-term and went back to Texas. Get a storm flag, they are huge and durable. This HOA needs to be put in their place. There is an Ombudsman who regulates disputes with HOA’s. It would be in favor of the owner to fly the American Flag. The HOA has no authority to prohibit it. Also, Pearl Harbor Remembrance Day, Dec. 7 is approaching. Fly your American Flags proudly. I have a Flag pole in cement in my front yard and my HOA approves of it. My Dad fought in WWII, many,many people after the attack on Pearl Harbor enlisted. I don’t remember anyone standing in line to enlist in the military after 9/11 and this country was attacked on its own soil. Goes to show that this generation wants the freedoms, but, they don’t want to fight for them. The culture and pride in this country has to change or we are doomed. This generation doesn’t know what hard times are. If we don’t pay attention to history we are doomed to repeat it.

It’s also too bad that they don’t allow schools to say the Pledge of Allegiance 1st thing before school starts, as they did when I went to school because it offends “them”. Proudly fly our flag. When my son served in Iraq, I put a flag in my front window and kept it there for his entire tour of duty. I’m also old enough to remember when whole communities and cities turned out for national holidays with parades and everyone was waving a flag. I guess the parades are out of fashion now but the flag is never out of fashion. So, be proud of your husband and thank him for all of us for his service. Fly that flag and I hope your neighbors get their own flags and join you!

I served in the USMC for seven years, was stationed at Camp Pendleton twice in ‘staging’ regiment to go to the Far East. While I’ve been out of the Corps since 1961 I know how most all Marines feel about this disgusting turn of events, especially in a military town like Oceanside, chock full of stiff necked Marines. I have an idea… have a squad of Marines from the most storied unit in the Marines, the 5th Battalion, 1st Marine Division, pay a ‘visit’ to those dirt bag members of that HOA and administer a good old fashion Marine Corp ‘attitude adjustment’ to each and every one. In addition those HOA nit -wits need to read and understand (if at all possible) the “Fly the Flag Protection Act” of 2005, including on the private property of residents in an HOA. If they still try to screw around with that Marine Wife, then open a can of ‘whup-ass’ and give’em a knuckle sandwich… two such sandwiches for good measure.

Most people that purchase a condo do not realize that they are only purchasing a home, apartment or dwelling from the inner walls to include any floor space enclosed by those walls.. None of the exterior walls or portion of the structure belong to the owner, this exclusion also includes the dirt (land).. The owner is required to maintain the building and the landscape but has no say in exterior colors, finishes or changes..This includes lanscapes..Like I said before, most HOA’s were started in Europe to save land…Builders here saw it as a great way to save money and put the the money saved into their own pockets here in the USA…To any true American that buys a condo or puts up with an HOA is truly a foolish American…Get off of laziness and buy a single family home free of the HOA commies…..This advice is from a retired California General Building Contractor

Seems to me that about 10 to 12 years ago there was a federal law passed that said that a HOA could not prevent you from displaying the American flag at any time you so desire. A veteran had been raising his flag every morning and lowering the flag every evening. Some liberal complained to the HOA who told the veteran to cease and desist which he refused to do. The HOA eventually told the vet to remove the flag or move out. Word got back to one of the sensible lawmakers in Washington and very soon there was a law to put the HOA in it’s place. See, not all lawmakers are swamp-scum!

I am almost 56 years old and I recall, when I was in the 8th grade, a kid came to school, wearing
a t-shirt, with “HELL, YEA! The Allman Brothers’ Band,” on the front of it. He was quickly disciplined.
Of course, this was in 1974 and times have changed, since then.
These days, that t-shirt would be allowed, while a t-shirt, with the name of the Most High God, on it,
would receive expulsion for the kid, wearing it.
Needless to say, the woman’s husband is also protecting the right to Freedom of Speech, which is what
those facists hide behind, while they demand patriotism and Christendom must not be allowed the same
rights!!
And, we owe it to the wimps, who are allowing ungodly things to be allowed, while changing America into a
