President Barack Obama has announced plans to nominate a Supreme Court justice in the next few weeks that he claims will be a good compromise candidate for his Republican rivals.
Senate Majority Leader Mitch McConnell responded yesterday by telling the president not to even bother, because the GOP isn’t buying Obama’s claims for a second.
McConnell emphatically ruled out any Senate action on whoever Obama nominates to fill the Supreme Court vacancy, an extraordinary step that escalated the partisan election-year struggle over replacing the late Antonin Scalia.
After winning unanimous public backing from the 11 Republicans on the Senate Judiciary Committee, McConnell told reporters that that panel would hold no hearings and ruled out a full Senate vote until the next president offers a nomination. Such steps would defy many decades of precedent that have seen even the most controversial choices questioned publicly by the Judiciary Committee and nearly always sent to the entire chamber for a vote, barring nominees the White House has withdrawn.
“In short, there will not be action taken,” McConnell told reporters.
The Kentucky Republican said he wouldn’t even meet with an Obama selection should the White House follow tradition and send the nominee to Capitol Hill to visit senators.
“I don’t know the purpose of such a visit,” McConnell said. “I would not be inclined to take one myself.”
Democrats have accused Republicans of following the lead of billionaire Donald Trump, a leading GOP presidential candidate who’s called on Senate Republicans to derail any Obama court selection.
“The party of Lincoln is now the party of Donald Trump,” Senate Minority Leader Harry Reid, D-Nev., told reporters.
Filling the vacancy left by Scalia’s unexpected death on Feb. 13 is crucial because without him, the Supreme Court is left in a 4-4 ideological knot between justices who are usually conservative and its liberal wing. The battle has invigorated both sides’ interest groups and voters who focus on abortion, immigration and other issues before the court.
After meeting privately with GOP senators for the first time since Scalia’s death, McConnell and other leaders said rank-and-file Republicans were overwhelmingly behind the decision to quickly halt the nomination process.
“Why even put that ball on the field?” Sen. Pat Roberts, R-Kan., said of hearings. “All you’re going to do is fumble it. Let the people decide.”
McConnell and other Republicans have said the high court vacancy should not be filled during a presidential election year and that the voters — by electing the next president — should choose who makes that nomination, pointing out that it’s been over eight decades since a nomination occurred and was filled in the same election year.
“Because our decision is based on constitutional principle and born of a necessity to protect the will of the American people, this committee will not hold hearings on any Supreme Court nominee until after our next president is sworn in on January 20, 2017,” Judiciary Committee Republicans said in their letter to McConnell.
In remarks Tuesday at Georgetown University law school, Justice Samuel Alito sounded unfazed about possibly spending the rest of this year in a court whose members are locked in a 4-4 tie.
“We will deal with it,” Alito answered when asked about Republicans’ resolve to oppose anyone Obama nominates.

The republicans best not capitulate on this issue. If they do they will lose the majority of there votes.
It was foolish and unnecessary to take a position on any nominations to SCOTUS. McConnell and the Judiciary Committee should have held hearings and then if a nominee didn’t reflect a record of impartiality,the nominee should have been rejected. Publicly posturing prior to a nomination could only serve to alienate non-partisans.
McConnell is beginning to sound more like the guy we all knew and appreciated. Don’t fold on this issue or we could be in Real Serious Trouble.

McConnell’s mouth will not cost the GOP when the Senate and Congress seats are up for re-election… The ultimate ideal plan is for GOP to win the White House, Control the Legislative Branch, and grow GOP State Governors. GOP is on that path now EXCEPT McConnell may have just giving the legislative purse strings to the Democrats come next few rounds of Congressional elections.

The fact that this is an election year is the only reason McConnell is taking this stand. Any other year not only would he stand up and rally in favor of the president’s nominee, he might also threaten his fellow Republicans if they didn’t.

Hang in there Senator McConnell. We should not trust anything that President Obama chooses to call a compromise. The Senate has an obligation to fully investigate and vet any nominee before a confirmation hearing is even considered. A nomination by the President is not an automatic appointment. It is up to the senate to decide if the nominee is acceptable. They have rejected nominees before.
Well, this is the most sensible post I’ve seen. Let Obama send over his nominee. (And then his second nominee …. and then his third.) Interview them, grill ’em, show what obvious liberal fanatics they would be on the Court. And then just stall ….. or reject. The Republican party would gain more from opening up the door ….. before they close it rather slowly …… than just slamming it shut in Obama’s biased, prejudiced face before the “games” even begin.
Justices of the supreme Court have mostly been judges previously. How ever it is not required and some were not. It could work out that some present day office holders and candidates that are not available to be a justice now, would be available a year from now. Should Trump become our president, I wonder about Cruz. He would make an excellent justice. He has the needed personality, temperament, integrity, and determination to make an excellent justice. If he is available, we need him in that seat. Also, he does have legal experience in practicing before the Supreme Court.

THE Congress and Senate could permanently or temporarily reduce the Supreme Court to eight seats from nine and then , say next year, raise it back to nine. This would need to be a veto proof vote in both houses.Also, they could put the bill before the house,then keep it bogged down in committee hearings until the time runs out.

Mitch is stating that he will go against the direct wording of the Constitution — “the President SHALL (means MUST) appoint Judges to the Supreme Court”. Obama is the President, and he MUST make an appointment. Not having a nine-judge Supreme Court for a year will cause problems in the federal government for both Dems and Republicans. It is bizarre that Mitch will say he stands by the Constitution in one context, but not in another. That is the definition of a hypocrite, not a Republican.

If the Constitution is to be followed, then President Obama has a Constitutional responsibility to appoint a replacement Supreme Court Judge. That is the wording of the Constitution. You can’t deny that. It may be possible to delay confirmation until Trump becomes President, but you can’t stop Obama from making a selection.

McConnell’s stance is the only chance we have of getting this president to nominate a middle of the road jurist. For President Obama this becomes an interesting challenge a liberal appointment is not going anywhere. If Obama should try to nominate a moderate or conservative leaning judge then the Senator would have to backtrack on his pledge or take the risk that if Hillary is elected she would submit a radical liberal to fill the vacancy.
Throughout his time in office President Obama has been unwilling to work with Republicans or try to find compromises which would work for everyone. He has governed by executive order and bypassed Congress. Now, as his time in office winds down, Obama is faced with the reality that the Senate will deny him the ability to seat a judge on the Supreme Court who could possibly remain in that position for three or four decades.
This highlights a problem with our dysfunctional government. Every judicial vacancy becomes a political battle as each side hopes to get someone on the bench who will advance or at least be sympathetic to their agenda. Maybe we should return the Constitution and let Congress create the laws and sort out the issues rather than having 9 unelected judges make those decisions from the bench.
