Legal scholars have squared off in public debate on whether Republican Ted Cruz is eligible to become president. Now, the issue is heading to the Cook County Circuit Court in Illinois.
A judge has agreed to hear arguments, starting today, on Cruz’s eligibility to appear on the Illinois ballot.
Even though Cruz is likely to win the legal challenge, experts say the fact that his eligibility will remain doubtful could spell disaster for voter confidence in his candidacy. And in an increasingly tight presidential primary, voter confidence could be the difference in the race for the 2016 GOP nomination.
The question has been in the national spotlight since Republican rival Donald Trump suggested that Cruz, who was born in Canada to an American mother, isn’t legally qualified to be president. And a recent debate at Harvard Law School on Cruz’s eligibility underscored that conflicting interpretations of the U.S. Constitution can produce different answers.
Much of the legal debate weighs whether Cruz is a natural born citizen, a requirement under the Constitution to become president that the document never defines.
Harvard professor Larry Tribe argued in a debate that, based on legal principles from the country’s early history, only those born on U.S. soil can be considered natural born citizens. Granting that status to Cruz, then, “is at odds with the text, the structure and the founding history of the Constitution,” said Tribe, who once taught Cruz as a Harvard law student.
But by the time Cruz was born, newer laws would have made him a U.S. citizen because his mother already had that status, said Jack Balkin, a constitutional law professor at Yale Law School.
Balkin’s argument is hinged on the idea that the newer rules, created by Congress, changed the definition of a natural born citizen. Tribe said Congress doesn’t have that right.
Cruz has previously said it’s already settled that he’s legally eligible, and he called Tribe a “liberal left-wing judicial activist” who supports Democrat Hillary Clinton. Tribe responded by taking a few jabs at his former student, but added that Cruz “was a fun student to have; I enjoyed jousting with him.”
Tribe said he isn’t dismissing the possibility that Cruz could be eligible for the White House, but he insisted that it’s still an open question.
“In no possible sense has the issue been settled, either by the Supreme Court or by political processes or by popular consensus,” Tribe said.
Other scholars have recently taken sides on the question while presidential candidates stump across the country. Cruz and other candidates were in New Hampshire Friday ahead of Tuesday’s first-in-the-nation primary election.
Now, the debate is no longer academic — it hast been taken up by the judicial system. And both professors said it has the potential to end up before the Supreme Court, which would tie the Cruz campaign in a long, dangerous legal battle when they’d rather be focused on battling for votes.

I don’t trust this matter in Illinois Court because Illinois is one of the most corrupt States and Court systems, especially in Cook County! This could be a whole other strategy by the Clintons (she is from Park Ridge IL) to gain an advantage by getting a favorable Illinois judge to say Cruz is eligible (initially), and later Clintons / DEMs bring suit – if Cruz is GOP nominee – challenging the finding and have him derailed in the general election.
50 years from now we will likely learn that the Obama Presidency was an embarrassment, electing an individual not born a U.S. Citizen. In college Obama received foreign aid grants and was allowed to travel to Countries barred to U.S. Citizens at that time. If you had duel citizenship and then ran for an office: dropping your citizenship in Canada, would you then not be trust worthy? It has been public and is not a problem. Dr, Dobson with Focus on the Family and others who personally know Cruz stand by him and Trump wanted him for his vice president until Cruz began obtaining more votes than him: then he turned and began to make up lies against Cruz. I was a birther, so I definitely have questions about Cruz. A Republican Lawyer explained it well, and he said to be a natural born citizen, you have to be born on U.S. Ground. Cruz is a citizen, but not a natural born citizen as he was not born on U.S. soil. He went on to explain the difference with military parents of U.S. Citizenship, like John McCain, whose parents were working for the government and were born to both U.S. citizens as natural born, but, as he said, Cruz’s parents were NOT working for the government, his dad was working in Canada at the time. HOWEVER, after what Cruz pulled on Dr. Carson, and the hypocrisy of everyone who claims Cruz just announced what CNN said, is beyond the pale. He committed voter fraud, he is a dirty politician, and even if he was the nominee, I will not vote for him, but will write Carson’s name in. I refuse to vote for another Ivy League Attorney taught to lie at anyone’s expense, and my candidate lost thousands of votes because of him. I remember hearing a radio interview with a political figure from Kenya who said in no uncertain terms that Obama’s birth site in Kenya has become somewhat of a shrine honoring one of their own becoming President of the United States. This along with Obama’s own Grandmother stating that he was born in Kenya is enough for me. Not to mention that Obama’s sealed school records I am sure hide the fact that he was classified as a foreign exchange student and had received financial support as such. Obama had no business becoming President, let alone twice. And I have to say that if I had to use the knowledge I have on the subject of being a ‘natural born citizen’ as it relates to Cruz, he would NOT qualify, and would not be permitted to run for President. Now that Justice Scalia is dead and God only knows when he will be replaced, by the time this BS makes it to the supreme court it will be too late now won’t it? My understanding is being an American Citizen is not the only requirement placed on someone becoming President of the US. It also states the person must be born on US Soil, not born somewhere else and becoming a US citizen because parents were AMERICAN citizens. That language was put in because another country added that language because people born in other countries could become politicians and favor that other country and not the country they are working for. That language was added to prevent this and allow an American Citizen, Born in USA to become President of the United States, I know some people think that language is no longer fitting for today and should be changed. The US has given up many things do to changes and interpretation of language and I feel enough is enough because I want everything that made us strong in the beginning.
So explain how children born of parents in the US military stationed overseas when their child was born is a US citizen, oh brainy one!
McCain is a perfect example of this. He was born in the Panama Canal region to two American Parents and was vetted to be able to run for President. They said the fact he had two American parents, and was born on a U.S. Military base was proper, as the base was considered American soil. Canada and Kenya have no such distinction.
I believe that if you are born where our military is deployed and stationed, that it is not under that country’s law, but remains run by our US government. When both wife and husband are US citizens live on a military base in another country, and a child is born, it will remain a citizen of the US.
When in the Military; all bases our considered to US soil just the same as Embassies located in foreign lands our protected by US Military personnel!!

The issue is NOT whether or not Cruz is an American Citizen. The issue is whether or not Cruz is a NATURAL BORN American Citizen which is necessary to be eligible for President or vice President. Cruz is NOT natural born as he was not born on American soil of PARENTS (note both parents) CITIZENS. This is required by Article II, Section 1, Clause 5.
Exactly.. His mother had to file CRBA papers to confer her citizenship to him.. This is called “naturalization” and has had his CRBA documents sealed.. Naturalization and Natural Born or not the same thing, this is why both are noted in the constitution.. No natural born citizen has to file for citizenship with the local consulate.. Additional his mother could not confer her citizenship to him for 7 years after his birth because they chose to give him Canadian citizenship at birth.. She may very well have not had US citizenship to confer as she was a registered voter in Canada in 72 and 74.. In order to met this requirement she had to give up her US citizenship.. This is a mess and Mr TrusTED is a liar and he knows this, hence his sealed records.. Have we not learned anything about professional politicians with sealed records..?
I agree. He was born in Canada and lived there for four years. Does not sound like a natural born citizen eligible for the president. Also, heard his parents voted in Canada? Gets weirder as he was Canadian citizen up until 1 1/2 years ago. Being an attorney you would think he would realize he was not eligible. Something is definitely not right. You are right. Initially I thought he was not eligible to vote based solely on the NBC aspect and BOTH parents NOT being citizens. Rafael Cruz was a Canadian citizen in 1968 and did not become a U.S. citizen until 2005. In the past 10 days after reading about the CRBA and the Canadian Citizenship Act of 1947, it appears the mother must have relinquished her American citizenship. Since Canada prohibited dual citizenship between 1947-1977–it was impossible for Ted Cruz to have both American and Canadian citizenship. It appears he was a Natural Born Canadian citizen. It also appears he may be illegally sitting in the Senate. AND….if the mother would have elected to choose American over Canadian citizenship (which obviously she did not) this would have amounted to Naturalization—not Natural Born.
The question is NOT whether or not Cruz is an American! I doubt there are many, if any, trying to say that. The question is whether he qualifies under the Constitution as a Natural Born Citizen. This would be his being considered an American citizen from birth based on the Constitution alone, and not any later Congressional laws that were passed. There is no way he can be considered Natural Born without considering some of the later laws that Congress passed (which could not and did not change the Constitution or the definition of what it meant to be a Natural Born Citizen). Since his argument for qualifying is based squarely on later Congressional laws, and not the Constitution itself, he can not possibly qualify. Understand that Congress in regular session has NO authority to modify or change the Constitution AT ALL! The very need for a separate act of Congress to make him a “Citizen” at birth immediately disqualifies him as being a “Natural Born Citizen” based on the Constitution. ANY act of Congress required to consider him a Citizen at birth amounts to nothing more than a form of immediate naturalization that takes the possibility of the other off the table completely. This is my understanding based on the Founding Father’s intention, original law that dealt with the issue, and common sense.
My ex-husband was born in Poland and his mother was born in the US. She went to Poland to visit her family and gave birth while there. He was not considered a Natural American citizen. He was here on a legal Visa when we married, but was told he needed to apply for citizenship each time he went to renew his Visa. He had passed away before he received his citizenship. His mother needed to remain in Poland or her son would have had to stay behind with her family. She was able to get him into the US legally but he was still considered a citizen of Poland. That was 1962. He was born in 1951. Were things different back then?
Pardon me….Was it proven that Obama’s mother was an American citizen. Where he was born is a question but according to the records he was born in Hawaii and as remember Hawaii is part of the United States of America. No other place has ever been proven. Ted Cruz is a different story. He was born in Canada of an American mother yet he and his mother became canadian citiazens. I am confused…he held dual citizenship till he decided to run for president. Is he doing this to test the constitution or to test the American people to see how uninformed they are. If you are not born in America or on american territory I don’t think you are a citizen. If this is not true we have another problem with anchor babies. Do they have dual citizenship with Mexico and the United States and can claim either just because their mother was Mexican. How can things go two ways. Definition of a Natural-born citizen, very simple: A United States born man, raised with American values, and a United States born woman, raised with American values, have a child (whether born in the States or not). That child is a natural born citizen. Oblamo was a major mistake, not a precedent!

Two wrongs do not make it right. The law states that in order to be elected president, a candidate must have either been born on US soil, or be born of parents that were born on US soil. The s at the end of Parent makes the word plural, meaning 2 or more. Both of neither his nor O’bama’s parents were born on US soil. Neither of them is leagally eligible to be president. Should the supreme court rule that they MUST abide by the law, they should immediately remove O’Bama and undo all of the changes he made, that are done in a criminal matter, as it was done during the commission of a crime, therefore, not legal. This law was made, to make sure that the leader of this country would have this country’s best interest at heart. Looking at how O’Bama made laws that are not in the best interest of this nation, you can clearly see WHY the writers of the constitution, wanted it to be clear the president must be 100% US citizen. Having citizenship of only 50% could mean that of the presidents laws and executive orders made, there is a 50% chance, that they could better benefit another country, at the risk of harm to this nation. I hope the supreme court really gets to rule on this one, because just one judge’s opinion could be wrong, and do more harm to this nation.

Trump did not bring up the issue with Cruz and Natural Born requirement. Many of us have been writing about this issue for years because we knew that Cruz and Rubio were not eligible any more than ‘Hussein’ Obama is. John McCain owes his “natural born” status to an Act of Congress passed the year after his birth in which everyone born in his circumstances was granted natural born status dating all the way back to 1915. McCain was born on foreign soil. For that matter, George Romney, who ran for president in the 1960s, was born in Mexico. Do you know what the United States Code is? If you don’t it is US law, organized into 54 titles by subject. 8USC, section 1401, clearly states that Cruz is a natural born US citizen. This has been carried forward ever since the 1790 law, which, while it says it has been repealed and replaced by the 1795 law, which was R&R’d by the 1805 law, and so one up until1952. People don’t realize that these laws, while they SAY “repealed and replaced, are actually mostly carried forward by means of notation. (“Except in the case of ……..) . Most of the original 1790 law is still in place due to this practice. Why else would a law supposedly repealed and replaced in 1795 still be used as legal authority in legal briefs to this day? Under the 1952 revision of this law, Cruz is a natural born citizen of the US, because of his mother’s status as a natural born citizen. I have heard numerous people say that Canada did not allow dual citizenship with the US at the time of Cruz’s birth, citing a 1947 Canadian law to that effect. Apparently, they never read the law they cite as their “evidence.” I did read it, and it says no such thing. Canada most certainly did and does allow dual citizenship with babies born to US citizens in Canada. The people questioning Cruz’s status are simply anti-Cruz, rather than pro-Constitution. Don’t you think if the Framers had wanted a Constitutional definition of “natural born,” they would have made sure it was included? Article I of the Constitution gives Congress the authority to establish rules of naturalization. For those of you who think this does not include natural born, why was the law of 1790 which stated children born abroad to US citizens were natural born carried forward to this day? If Congress has no authority to pass a law defining natural born, how is it that they passed one in 1937 which declared John McCain and all other born in the same circumstances, dating all the way back to 1915, “natural born?” How is it that Naitve American Indians, who were not even citizens until made so by an Act of Congress (NOT a Constitutional Amendment) are now considered “natural born?” (See Indian Citizenship Act of 1924). One last thing: There is nothing in US law, or the Constitution that says a person having dual citizenship cannot be considered a “natural born” US citizen.

Unfortunately, Cruz can not be elected as president. He knows that he is not eligible to run for president. Those military children who were born in Germany in the late 60’s and 70’s to U.S. citizens are not natural born citizens. They were naturalized and their parents had to get them a green card to bring them back to the states. It wasn’t until 1986 when a law was passed that made military children born in foreign countries a natural born citizen. That law specifically does not include children born prior to 1986. So they are not grandfathered in. If Cruz is eligible, we wouldn’t need the law that was passed in 1986. Most people are not familiar with this unless you or your family members were military that were having children overseas during that time period.
MIlitary families are a different matter. Under 8 USC, section 1401, (you can google the text), A child born to US parents ir a US oarebt in a foreign country is a US citizen at birth, with no need for any sort of naturalization. This is the definition of Natural Born. Read the law. Military families are dealt with separately from civilian. I don’t know why,but there is a separate section for them. The law isn’t very long. Read it for yourself. Those who say a Consular Report is required, (the infamous CRBA) are mistaken. In 1970, at least, it was not. It was recommended, but not required.

Actually, there is a thing called “net-etiquette” or “netiquette” that recommends not using all caps. It is considered shouting and not very polite. For me, it makes the post difficult to read. Walter, I totally agree with you. We have become a nation run by and ruled by money. I can almost bet that many of the strange things, unexplained things, that have happened in our government lately have been covered up and bought off by the almighty dollar and greed.

The document you refer to is a PRELIMINARY Canadian voter registration list, NOT the finished, legally accepted document. It mistakenly listed Mrs. Cruz as a Canadian citizen, since her husband was one. She was not. More importantly, even if she was, she was NOT in 1970 when Cruz was born. Anyone saying that Elizabeth Cruz was a Canadian in 1970 is either mistaken or lying. Canadian law in 1970 required four years as a permanent Canadian resident for citizenship, and Mrs. Cruz did not even arrive in Canada till 1969. She still had two years to go when Ted was born. Mrs. Cruz was a natural born US citizen. The only way you can lose that status is by a voluntary renunciation. This renunciation would have a record in both the US, and in Ottawa, Canada. There is no such document in either country, ergo, it never happened.

Yes, Tony, it was most definitely an issue prior to the 2008 election. There were several lawsuits filed. The problem is that in order to have “standing” to bring suit, you must be directly harmed by the action being challenged. Almost all the lawsuits were dismissed for lack of standing.
I have argued that Cruz should actually find someone to bring a legal challenge, not wait for someone else to do it. Whether he and Rubio and Jindal and possibly Santorum are or are not eligible, the issue needs to be squarely faced and decided, once and for all, for the good of the country.
There are not many errors I ascribe to our founders in the way the established our nation, but the lack of a “glossary of terms” in the Constitution created major problems down the road (like now).

What are you talking about? Cruz was brought to this country when he was four years old, in 1974, and has been here ever since. He is natural born according to 8USC section 1401 of the US Code. US military bases are not necessarily US soil. John McCain and others born in the same circumstance were made “natural born” US citizens by an Act of Congress in 1937. Cruz is one by virtue of an Act of 1952. For that matter, George Romney, who ran for president in the 1960s, was born in Mexico.

There were a lot of us concerned that Obama was not eligible to be President of the United States, but the “powers” that be in the political establishment helped him produce a questionable birth certificate and to hide all his collegiate records which would provide evidence of his citizenship. For heavens sake, his social security number was even proven to be from a state he presents no residential ties to.
The Ted Cruz question begs for an answer as to when his Mother became a Canadian citizen. If she had renounced her American citizenship in 1970 before Mr. Cruz was born, possibly at the same time her husband renounced his Cuban citizenship to naturalize as a Canadian, then Ted Cruz would in no way be considered a “natural born” American citizen. If her action was delayed until after his birth, then it would be up to the courts to decide. It has been acknowledged that both parents at some point became Canadian citizens, with his father naturalizing as an American citizen more recently in 2005, even though the Cruz family moved to the United States from Canada when Ted Cruz was only about 3-4 years old, in 1974.
The “natural born” requirement is to meet Constitutional requirements. It has no reflection on the qualifications of the individual.

It is sad that so many Americans are UN-educated when it come to the constitution, and that the US Supreme Court has ruled on what the term “Natural Born” means not once but four times. The conclusion of each of those rulings is that to be a “Natural Born Citizen” then you have to be born to parents that are also citizens of the US at the time of your birth. If you don’t believe this, then do your own research. This really reminds me of what I heard a Judge in a Court room once say “Ignorance of the Law is no excuse”. So again do your own research of Supreme Court Rulings (also known as Case Law), and then make up your own mind as to the truth, and stop depending on the media, and others to tell you what is and isn’t the truth!!
There has never been a Supreme Court ruling on this topic. There have been opinions published but that is not the same thing by a long shot. There is a HUGE difference and an opinion is not case law.

Whatever you think the standard should be, what the standard IS, according to US law, found in 8USC section 1401, is that a person born on foreign soil to one US citizen parent is a natural born US citizen. I wish people would look this stuff up instead of relying on someone else’s opinion who is relying on someone else’s opinion, and none of them KNOW what the law actually says. I have never heard so many “legal experts” offer so many erroneous opinions based on misinformation and misunderstanding.
As much as I hate to say it, the definition of natural-born citizen is probably going to need to be handled by the Supreme Court. I’ve read legal opinions from scholars on both sides of the issue. Ultimately it is up to a judge to decide which argument is going to prevail.
I wish the issue of Sen. Cruz’s eligibility would be resolved. I was taught in school that the natural-born citizen qualification limited the presidency to someone born on American soil. If that is not the case, I would support Ted Cruz. He seems to be the best qualified of all the candidates to lead America in a conservative direction. What these OPINIONS have stated is that being born in the US to citizen parents makes you natural born. At NO TIME did they ever state this was the only way that the requirements for “natural born could be fulfilled. It is A way, not the ONLY way. There is a mountain of US law to the contrary, from 1790 until 1986.
I stand corrected, and concede that you are correct in that the US Supreme Court has not defined the term “Natural Born” as it pertains to the US Constitution. But I was also say this about the mountain of US law to the contrary, neither does any of these law clearly define the term “Natural Born” as it was meant by the framers of the Constitution. I personally believe that can and should only be done by the highest court of our land the US Supreme Court, and if they would, that would put to rest the concerns that both sides have to this age old question.

I was born in Brisbane, Australia to an American Father in the US Navy and an Australian mother. I am a veteran with three tours in Vietnam with a LOT of medals that came from that. I’m verified as an American citizen, but have been told by the legal system, and the federal government, that I can’t run for president. This was stated, in writing, about 15 years ago during that verification, and was according to Constitutional Law. I would NEVER run for president, but doesn’t this apply to every one including Cruz?
Also, it has been proven by a number of different people, and agencies, that the short form birth certificate from Hawaii that Obama posted is a forgery, and that the hospital listed on it had NO records of him on file at that time. It has been stated by him, his grandmother, his brother, and other relatives that he was born in Kenya. He came to this country through Canada to Chicago on a FOREIGN student ID. Those college records have been sealed by Obama. The more I learn of this, the more I wish to stay away from it, completely.

Richard, I don’t know why, but the law is different for US military personnel and their children, at least in some cases, than it is for the children of civilians. I personally think that lawyers deliberately obfuscate everything so that the average citizen has to hire one to prevail. The law should not be so complicated that an average person with no special legal training cannot understand it. This is elitist, and deliberate. I have had some of that training so I know how to look stuff up. Very few people have. Most people are at the mercy of a legal system they don’t understand. The fact that nearly 70% of Congress lists their current or former profession as “lawyer” has a lot to do with it, I am sure.
I am constantly amazed how so many people hear ONLY what they want to hear!! When one person SAYS all the right stuff – how does that automatically make it what they actually believe. Don’t you all know that saying one thing and believing another is a good definition of a lie? And we have candidates who call eachother liars – sounds to me like the pot calling the kettle black! They are all saying what they think will get them elected!! Be smarter than that and look at their past and their records!! Those things are indicators as to how they will be in the future! There is another issue with Cruz that no one seems to be addressing. He held Canadian citizenship. He admitted it. He cancelled it publicly. This was also true of Obama who was also a declared citizen of Indonesia. There have been many attempts by Republican and Democrat dirt bags to change the rules…why? Because those rules, that are being broken in candidates like Cruz, Obama and Rubio, were legal blockades against anyone with foreign allegiances (ie: New World Order for one) becoming POTUS. Those legal and very reasonable rules would cause problems for the dirt bags who wanted to destroy our Republic in putting their puppets in what has become under Obama a dictatorship. We cannot sit back and allow someone who professes to be on our side to break the same laws we fought to maintain when we fought the illegal installation of ‘Hussein’ Obama.

Cruz and Rubio are politicians and Rubio is simply dirty (look at his history with a major family drug dealer and his personal friends and escapades) as well as ineligible since his parents were NOT citizens when he was born. There is a difference between being popped out on our soil vs. being born to American citizen parents. Confidential sources have recently revealed that Obama will run for the presidency of Kenya in that country’s next national election. Obama supporters have assured doubters that Obama was born in Kenya, and tribal documents will prove he was and still is a native-born Kenyan.
Unfortunately, Cruz can not be elected as president. He knows that he is not eligible to run for president. Those military children who were born in Germany in the late 60’s and 70’s to U.S. citizens are not natural born citizens. They were naturalized and their parents had to get them a green card to bring them back to the states. It wasn’t until 1986 when a law was passed that made military children born in foreign countries a natural born citizen. That law specifically does not include children born prior to 1986. So they are not grandfathered in. If Cruz is eligible, we wouldn’t need the law that was passed in 1986. Most people are not familiar with this unless you or your family members were military that were having children overseas during that time period.

Donald Trump is actually right about something: Sen. Ted Cruz (R-Tex.) is not a natural-born citizen and therefore is not eligible to be president or vice president of the United States.
The Constitution provides that “No person except a natural born Citizen . . . shall be eligible to the Office of President.” The concept of “natural born” comes from common law, and it is that law the Supreme Court has said we must turn to for the concept’s definition. On this subject, common law is clear and unambiguous. The 18th-century English jurist William Blackstone, the preeminent authority on it, declared natural-born citizens are “such as are born within the dominions of the crown of England,” while aliens are “such as are born out of it.” The key to this division is the assumption of allegiance to one’s country of birth. The Americans who drafted the Constitution adopted this principle for the United States. James Madison, known as the “father of the Constitution,” stated, “It is an established maxim that birth is a criterion of allegiance. . . . [And] place is the most certain criterion; it is what applies in the United States.”
Cruz is, of course, a U.S. citizen. As he was born in Canada, he is not natural-born. His mother, however, is an American, and Congress has provided by statute for the naturalization of children born abroad to citizens. Because of the senator’s parentage, he did not have to follow the lengthy naturalization process that aliens without American parents must undergo. Instead, Cruz was naturalized at birth. This provision has not always been available. For example, there were several decades in the 19th century when children of Americans born abroad were not given automatic naturalization.
Article I of the Constitution grants Congress the power to naturalize an alien — that is, Congress may remove an alien’s legal disabilities, such as not being allowed to vote. But Article II of the Constitution expressly adopts the legal status of the natural-born citizen and requires that a president possess that status. However we feel about allowing naturalized immigrants to reach for the stars, the Constitution must be amended before one of them can attain the office of president. Congress simply does not have the power to convert someone born outside the United States into a natural-born citizen.
Let me be clear: I am not a so-called birther. I am a legal historian. President Obama is without question eligible for the office he serves. The distinction between the president and Cruz is simple: The president was born within the United States, and the senator was born outside of it. That is a distinction with a difference.
In this election cycle, numerous pundits have declared that Cruz is eligible to be president. They rely on a supposed consensus among legal experts. This notion appears to emanate largely from a recent comment in the Harvard Law Review Forum by former solicitors general Neal Katyal and Paul Clement. In trying to put the question of who is a natural-born citizen to rest, however, the authors misunderstand, misapply and ignore the relevant law.
First, although Katyal and Clement correctly declare that the Supreme Court has recognized that common law is useful to explain constitutional terms, they ignore that law. Instead, they rely on three radical 18th-century British statutes. While it is understandable for a layperson to make such a mistake, it is unforgivable for two lawyers of such experience to equate the common law with statutory law. The common law was unequivocal: Natural-born subjects had to be born in English territory. The then-new statutes were a revolutionary departure from that law.
Second, the authors appropriately ask the question whether the Constitution includes the common-law definition or the statutory approach. But they fail to examine any U.S. sources for the answer. Instead, Katyal and Clement refer to the brand-new British statutes as part of a “longstanding tradition” and conclude that the framers followed that law because they “would have been intimately familiar with these statutes.” But when one reviews all the relevant American writings of the early period, including congressional debates, well-respected treatises and Supreme Court precedent, it becomes clear that the common-law definition was accepted in the United States, not the newfangled British statutory approach.
Third, Katyal and Clement put much weight on the first U.S. naturalization statute, enacted in 1790. Because it contains the phrase “natural born,” they infer that such citizens must include children born abroad to American parents. The first Congress, however, had no such intent. The debates on the matter reveal that the congressmen were aware that such children were not citizens and had to be naturalized; hence, Congress enacted a statute to provide for them. Moreover, that statute did not say the children were natural born, only that they should “be considered as” such. Finally, as soon as Madison, then a member of Congress, was assigned to redraft the statute in 1795, he deleted the phrase “natural born,” and it has never reappeared in a naturalization statute.
When discussing the meaning of a constitutional term, it is important to go beyond secondary sources and look to the law itself. And on this issue, the law is clear: The framers of the Constitution required the president of the United States to be born in the United States.
If his mother at time of Tadd Cruz’s birth was leaving in Canada without status of being a US Citizen, then Cruz cannot claim that he is a Natural Born Citizen. He is just a person who automatically from birth hold American Citizenship,
