President Joe Biden thinks he can stand by while hundreds of thousands of illegal aliens invade America every single month, and Americans will do nothing about it — but a former Trump administration official is proving he’s wrong.
A Trump-aligned think tank has released a bold new plan for the states to protect America’s borders… even if Joe Biden wants to stop them!
The whole plan is right there in the Constitution.
“The Constitution provides a firm foundation for states to act decisively in the absence of the federal government,” says the report, released by the Center for Renewing America.
And the author ought to know: Ken Cuccinelli was the Deputy Secretary of Homeland Security for the Trump administration. And before that, he was attorney general of Virgina — the top lawyer for the area closest to the capital. He knows what he’s talking about and what needs to be done.
States have always thought they can do nothing about immigration, because border security is a matter handled by the federal government—and it usually is.
But what happens when the feds refuse to do their job?

Article IV, Section 4 of the Constitution makes an iron-clad promise that “the United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them from Invasion; and … against domestic violence.”
The founders may have foreseen a drone-like Biden, who won’t keep this “guarantee,” so they gave the states a self-defense option.
The Constitution says that states can’t do certain things, like “keep troops” or “engage in War, unless actually invaded, or in such imminent Danger as will not admit delay.” And that’s exactly what’s happening in Joe Biden’s post-American border: an invasion.
“There can be no disputing that the influx of well over 1.3 million illegal immigrants this calendar year alone and thousands of pounds of fentanyl and other deadly narcotics, facilitated by the widespread human trafficking efforts of violent international drug cartels, constitutes an invasion of the southern border of the United States,” the report states.
The number of illegal aliens who crossed the border actually increased to 1.7 million this fiscal year, the highest in the history of the United States.
Americans are dying in this war.
The other side’s weapon of choice in this invasion is fentanyl, which killed “a horrific 57,550 people in 2020.” There’s also gang and cartel violence, smuggling ex-cons into U.S. safehouses, and a whole lot more.
In the face of this threat, Biden has basically decided to stand down. Vice President Kamala Harris told the population of Central and South America, “Do not come” — but nobody believes Kamala when she says those words. And the administration’s policies prove that we’re right.
The government is trucking, busing, and flying illegal aliens all over the country, to states whole time zones away from the Mexican border.
“The federal government has released some 600,000 illegal immigrants inside the United States in the past seven months, a clear abuse of parole authority and a reckless embrace of catch-and-release,’” the report says.
Biden has stopped building the border Wall, let human smugglers go free with a court date and a worthless promise they’ll appear, and thrown the door open to unaccompanied minors brought in by human smugglers and drug runners.
“The reality is that if the federal government refuses to faithfully execute its own laws, then the states have no recourse but to interpose themselves between the federal government and the people they have sworn to protect in order to achieve deterrence and the removal of illegal aliens,” the report says.
So, how can the states pull it off? Cuccinelli says there are three steps.
First, every governor is the commander-in-chief of their state National Guard. State troops can be sent to the border to defend America from invasion — the way people like Florida Gov. Ron DeSantis already did.
Second, America’s red states can form an “interstate compact on securing the border” that says the states will work together to repel the threat. They can send this to Congress, but they don’t need Chuck and Nancy to approve it before they get to work.
Third, they pass state legislation outlining exactly why they’re doing what they’re doing. That would give them a legal basis to repel invasion.
Cuccinelli is no idiot: He lays down the law, shows how governors can use it, and outlines how they can take control on the border today.
He also knows the Biden administration will prepare for one bucking legal battle, so he tells states to prepare. He also outlines other short-term tactics, like deputizing private Americans to arrest illegals and turn them over for deportation. They can regulate state contractors who move illegals like chess pieces all over the country. And they can have an answer ready to go when Joe Biden tries to federalize the National Guard.
And the conclusion shows they aren’t playing around.
“Those seeking to abandon our constitutional framework to attain their destructive political ends through open borders would do well to understand that there are far more aggressive policy solutions, many outlined in this paper, in the event of their continued lawlessness,” it says. “They should step back from the abyss now and help restore order on our southern border before it’s too late.”
