Sleepy Joe Biden’s lawyers suddenly sue Donald Trump’s DOJ

Former President Joe Biden’s lawyers raced into federal court Tuesday to stop the release of audio recordings of the 46th president discussing the classified documents that were discovered in his unsecured garage.

They want to keep Biden’s senile ramblings, and possible confessions, a secret. In classic fashion, President Donald Trump immediately called him out for it.

“A Crooked Politician!!!” Trump posted on Truth Social.

Biden’s legal team filed a lawsuit to halt the public disclosure and are demanding the courts block the Justice Department from releasing roughly 70 hours of audio recordings and transcripts to the House Judiciary Committee and the Heritage Foundation, a conservative think tank that had requested the materials under the Freedom of Information Act. The DOJ had scheduled the release for June 15.

The recordings are from private interviews with Biden at his home in 2016 and 2017 with ghostwriter Mark Zwonitzer, who helped him write his memoir “Promise Me, Dad.”

Special Counsel Robert Hur later obtained the tapes during his investigation into Biden’s illegal retention of classified documents from his time as senator and vice president.

“Every American, including a sitting or former Vice President, has a right to privacy in the personal conversations he has within his own home,” Biden’s lawyers claimed in their lawsuit. “When the U.S. Department of Justice obtains that private information through a criminal investigation, the Department bears a particular responsibility to protect it from disclosure.”

Critics noted that Biden is asking the Trump DOJ to protect him after years of his own administration stonewalling Congress on the exact same issue. In February 2026, the Trump DOJ reversed the Biden administration’s position and told Biden’s attorneys it planned to release the files.

Hur’s 345-page report, released in 2024, found that Biden had revealed classified information to Zwonitzer during the memoir sessions, which Biden later claimed he never shared with anyone. Hur ultimately declined to prosecute, and instead said Biden was “a sympathetic, well-meaning, elderly man with a poor memory.”

In one exchange of snippets of the audio published in 2025, Biden could not remember when his son Beau died. It’s further evidence of Biden’s advanced mental decline that the White House spent years covering up.

“Biden knew he had highly classified documents in his home, kept them for a reason, and held on to them for years. He knew, all along. He arguably broke the law,” CNN legal analyst Elie Honig said at the time.

Now Biden’s lawyers are trying one last, desperate court intervention to stop the release of the files.
