In a heated election year, it’s no longer uncommon to hear politicians accuse their opponents of breaking the law—but it is still unusual for that to come from a member of the same party.
That’s exactly the situation Joe Biden is facing: A new report shows that Biden’s criminality and blatant disregard for the law is so flagrant, even his fellow Democrats can’t excuse it any more.
Most Democrats have reacted by circling the wagons after Special Counsel Robert Hur released a 388-page report stating that Joe Biden wrongly took classified documents home—the same pretext Biden used when he sent federal agents to raid Mar-a-Lago.
Now, Biden should face the heat, said Hur, for committing even worse crimes…since Biden had never been president when he purloined the documents in question.
“It appears a crime was committed,” said Rep. Dean Phillips, D-Minn., on the Democrats’ second-favorite cable news channel.
When the CNN host pushed him to clarify, Phillips stood his ground: Biden was guilty.
“Based on what I read, he said there was evidence” to charge Biden with violating federal statutes governing the handling of classified documents, Phillips told Abby Phillip on “CNN Newsnight” last Thursday. “But he recognized that, by prosecuting it, they called him an elderly man with a fading memory and would be too sympathetic in front of a jury.”
Hur’s scathing report—which has nothing to do with allegations that Biden took bribes through his son Hunter’s “business consulting” contracts with foreign nations while vice president, and possibly as president—said Biden “willfully retained and disclosed classified materials.” But he declined to press charges, because Biden’s brain was so addled that jurors would see him as a “sympathetic, well-meaning, elderly man with a poor memory.”
Phillips has spent years trying to get his own party to face the facts on Biden’s corruption and cognitive decline. Now, he’s increasingly going on Fox News.
“The report simply affirms what most Americans already know, that the president cannot continue to serve as our Commander-in-Chief beyond his term ending January 20, 2025,” Phillips said in a statement to Fox News. “I invite fellow Democrats to face the truth” and back another horse before the contest gets underway.
Phillips told Fox News anchor Trace Gallagher that he’s against forcing Joe Biden out of office by invoking the 25th Amendment…but the voters will probably toss Joe out on his ear this November.
Biden is “weak and unelectable,” Phillips told Gallagher.
In a separate appearance, Phillips told Fox News host Jesse Watters that Biden’s performance was “just sad.”
“I want to really defend him: He is a decent man,” insisted Phillips. “We would not be having these conversations if he was not running for president again.”
The Fox News host poured cold Watters on that idea. “Wouldn’t a decent leader maybe put the country above his legacy and his ego, and do the right thing—or is that Jill’s job?” he asked.

Some commentators went all out, portraying Joe Biden with satanic horns, while eating ice cream.

But so far, Phillips—a wealthy, 55-year-old with a bright future—is running into one brick wall after another with his own party.
Phillips’ best shot at breaking through the electoral wall protecting Joe Biden from his own party’s voters came in New Hampshire…but he lost to Biden, who technically wasn’t even on the ballot.
Then he took a second stab at the king in the South Carolina primary—the first official contest on the Democratic Party’s calendar—and cut his credibility to pieces.
Phillips didn’t just lose; he came in third, behind self-help author and Oprah Winfrey pal Marianne Williamson.
Biden won 96 percent of the vote. Williamson came in second, with 2.1 percent. Phillips won a meager 1.7 percent of South Carolina voters.
That result proved so humiliating to Williamson that she dropped out of the presidential race last Wednesday.
But Phillips said he’s not going anywhere. “If somehow Joe Biden miraculously improves and he is in position to actually win this thing and I’m not, of course I’m going to fold it and get behind him,” he said.
Obviously, by pointing out a major report showing Biden committed numerous federal offenses, Phillips doesn’t think that’s happened yet.
He’s appealed for the Wisconsin Supreme Court to put his name on the ballot, since Democrats forced him off. The state Supreme Court gave Democrats until tomorrow to respond.
It’s just another way the Democratic establishment fights Phillips, and anyone who dares to put country above party, he says.
“The Democratic National Committee actively obstructs Democrats and Independents from ballot access — bleeding campaigns dry with lawsuits and absurd ‘signature requirements,’” Phillips wrote on X, formerly known as Twitter. “I’ve had to spend ~$2m to successfully overcome their barriers in 40+ states so far.”
“Democrats should win by appealing to our country, not suppressing our competition,” he wrote.

So far, there’s no sign the internal fire is going to stop. Even the night Phillips implied that our incumbent president broke the law, the Minnesota Democrat got shot down by someone inside his own party.
Sen. John Fetterman, D-Pa., said Phillips has “way too much money and he wants to piss it away and somehow help Trump.” He said Phillips should pursue “cheaper and more private” approaches to forcing Biden out, but Phillips is “irrelevant, as are any of the other third-rate kinds of campaigns now.”
“It’s going to come down to that same choice between Trump and Biden,” Fetterman concluded.
That’s exactly Dean Phillips’ point: If the 2024 presidential election comes down to a fight between the 45th and 46th presidents of the United States, Democrats won’t like which one the voters choose.
