Former New York Jets quarterback and Fox Sports analyst Mark Sanchez faces felony charges after a violent confrontation with a 69-year-old delivery driver left both men hospitalized Saturday night in downtown Indianapolis.
Marion County prosecutors charged Sanchez, 38, with one count of battery resulting in serious violent injury, a Level 5 felony carrying a potential sentence of up to six years in prison. He also faces misdemeanor charges of battery resulting in injury, public intoxication, and unlawful entry of a motor vehicle.
The incident reportedly occurred late Saturday when Perry Tole was exchanging used cooking oil at the Westin hotel as part of his regular delivery route. According to a probable cause affidavit obtained by Fox 59, Sanchez approached Tole’s truck smelling of alcohol and claimed he had spoken to the hotel manager, who said Tole could not be there.
Sanchez allegedly opened the door of Tole’s truck and climbed inside multiple times. When Tole tried to retrieve his cellphone from the vehicle, Sanchez blocked him. Tole moved between the Westin and nearby Marriott Downtown hotel attempting to flag down security, with Sanchez following him throughout.
The situation escalated when Sanchez shoved Tole. The delivery driver told authorities he used pepper spray in self-defense, but Sanchez wiped his face and continued advancing. Tole then pulled a knife and stabbed Sanchez multiple times before being knocked back into a dumpster. After a final stab wound, Sanchez gave Tole “a look of shock” and fled the alley. Police later found him at Loughmiller’s Pub and Eatery, which Sanchez entered to find help. Tole suffered numerous wounds, including a severe laceration that penetrated through his left cheek. Sanchez remained hospitalized in critical condition as of Monday morning.
Security footage from both hotels and a witness at the scene corroborated Tole’s account, according to police. When questioned by detectives, Sanchez said he could only remember “grabbing for a window” and had no memory of who stabbed him or how it happened.
Marion County Prosecutor Ryan Mears announced the felony charge Monday, citing the victim’s age and injury severity.
“This incident should never have happened,” Mears said. “What began as a disagreement between a 38-year-old former professional athlete and a 69-year-old man should not have escalated into violence or left anyone seriously injured.”
Tole filed a civil lawsuit Monday against both Sanchez and Fox Sports, seeking compensatory and punitive damages. The suit alleges assault and battery against Sanchez, and negligent hiring, retention, and supervision against Fox. Tole claims the network should have known about Sanchez’s “propensity for drinking and/or harmful conduct.”
The lawsuit states Tole suffered “significant injuries to his head, jaw and neck,” along with severe permanent disfigurement, loss of function, and emotional distress.
Sanchez’s family released a statement Monday evening: “This has been a deeply distressing time for everyone involved. Mark and our family are incredibly grateful for the concern, love, and support we’ve received over the past few days. Mark remains under medical care for the serious injuries he sustained and is focused on his recovery as the legal process continues. We would like to extend our heartfelt thanks to the first responders and medical staff.”
Sanchez was in Indianapolis to call Sunday’s Colts-Raiders game for Fox Sports. Brady Quinn replaced him in the broadcast booth following the incident.
