As Texas tries to keep illegal aliens out, the Biden administration has sued to let them in—even when the offenders have committed other crimes.
The Biden administration sued the state of Texas for placing barriers in the Rio Grande without federal permission—the only effective step that has kept some illegal aliens from crossing the border.
Biden, whom Republicans say has admitted at least 5.5 million known illegal immigrants during his term, has not only opened the border but opened the jail cells: He’s not deporting known criminal aliens.

“It’s hard to imagine a more dangerous and radical policy than the Biden Administration’s decision to allow violent criminals to roam freely in our communities,” said Texas Attorney General Ken Paxton, a Republican.
Biden is deporting only about one-third as many known, criminal aliens as President Donald Trump did just a few years ago.
The figures come from Rep. Tom McClintock, R-Calif., who told Congress:
- In fiscal year 2020 – the last year of the Trump administration — ICE removed 186,000 aliens from the United States. Two years into the Biden Administration, deportations have plunged to only 72,000 – a decline of more than 60 percent.
- The Trump Administration removed 104,000 convicted criminals from the country in fiscal year 2020, yet the Biden Administration only removed 38,000 in fiscal year 2022. That requires repeating. The number of convicted criminal aliens removed from our country has declined by nearly two-thirds under this administration.
- Similarly, in 2022, the Biden Administration removed just 60 percent of the number of known or suspected gang members as the Trump Administration did just two years earlier.
As bad as that is, the reality could be even worse. The average monthly number of retainers fell from an average of between 13,000 and 14,000 under President Donald Trump to 2,200 a month by March 2021, according to a report from Transactional Records Access Clearinghouse (TRAC) at at Syracuse University.
Democrats are “creating a dystopian nightmare for law-abiding citizens,” said McClintock, as he rattled off a number of murders and assaults carried out by criminal aliens known to immigration authorities, but who were never deported.
The attacks by illegals on U.S. citizens include:
- The sexual assault of a three-year-old at a Chicago McDonald’s;
- The sexual assault and murder of a 92-year-old woman in Queens, New York;
- The murder of a college student in Iowa;
- The assault of a teenage girl in Alabama;
- The assault and robbery of two friends at a Maryland park;
- The attempted abduction of a 4-year-old girl in Virginia;
- The murder of a 15-year-old boy in Maryland.
Another victim is 20-year-old Kayla Hamilton of Aberdeen, Maryland. In January, police arrested a 17-year-old illegal alien from El Salvador for her brutal sexual assault and murder. Records revealed the killer entered the United States as an unaccompanied minor, along with 14,136 others in March 2022.
Although officials knew he had tattoos bragging of his affiliation with the murderous gang MS-13, they put him in a group home with other teens, and HHS officials called him a “respectful young man” with “no behavioral issues.”

“These conclusions, in light of his brutal murder of Kayla, were obviously wrong,” said a congressional report released in May.
Not all criminals murder their victims: Police arrested Camilo Hurtado Campos of Franklin, Tennessee, ater finding evidence hhat the soccer coach had molested 10 boys; five girls also came forward as his victims. Somehow, Campos was able to do this although he had already been arrested at least four times, and ICE knew of his status as a criminal alien.
“It is imperative that we know what DHS knew about this criminal illegal alien that has groomed, and drugged, and raped these children in Franklin,” said Senator Marsha Blackburn, R-Tenn. “Tennesseeans want answers, and we’re depending on DHS to explain to us why they never deported him.”

Biden’s dereliction of duty at the southern border has become so flagrant that immigration experts have asked, “Are Biden administration officials deliberately engaged in alien smuggling and are they subject to criminal prosecution?”
Federal law punishes anyone who “brings … encourages or induces an alien to come to, enter, or reside in the United States” in violation of the law with a fine and a jail sentence of between five years and life in prison.
If the illegal alien kills someone, the violator gets the death penalty.

Since illegal aliens have died crossing the border as Biden’s open-borders policies force Border Patrol to watch silently, “it seems that the harshest penalties could indeed come into play,” wrote George Fishman of the Center for Immigration Studies last week.
Maybe punishing Biden administration officials will encourage them to do the one thing necessary to protect Americans from rampaging criminal cartels: follow the law.
“We are not enforcing our immigration laws. If we simply enforced those laws, there would be fewer criminal aliens in the country, and fewer crimes committed by them,” McClintock said. “It is that simple.”
