They haven’t beaten President Donald Trump yet. They don’t even have a candidate lined up against him.
But that hasn’t stopped the left from plotting their first move in 2021, should they win next year’s presidential election.
Liberal activists are quietly working behind the scenes on a secret plan funded by dark money groups to attack the federal court’ system the moment Senate Minority Leader Chuck Schumer and his Democratic allies take back the White House.

“It is essential to be ready on Day 1 of a new administration with names to fill every vacancy,” Nan Aron, president of the leftist group Alliance for Justice, told The New York Times.
Her organization and others have united to create an initiative called Building the Bench that would not only name judges to fill any federal vacancies but also work behind the scenes to replace aging liberal justices with younger – and even more progressive – nominees.
And they want to ensure Schumer and whoever is elected president can start the moment the inauguration ends.
“This is to start identifying people so the new president won’t waste a minute in addressing this need,” Aron said.
Just don’t ask what those “names to fill” are. They might be “identifying people” privately… but this secretive group ISN’T going to list those names publicly.

That has conservatives outraged.
Carrie Severino, president of the conservative Judicial Crisis Network which helped to support the Supreme Court nominations of Neil Gorsuch and Brett Kavanaugh, slammed the secretive plot.
Trump, she noted, “had no problem” making his list of potential court picks public during the campaign to “let the American people see the kind of judges he would appoint.”
No secret backroom deals with dark-money groups.
Just a public promise — one he campaigned on, and one he kept as both Gorsuch and Kavanaugh were on his lists.

“Why are left-wing dark money groups and Dems not willing to do same?” She asked. “What are they hiding?”
What they’re hiding is a plot that reeks of collusion.
As the New York Times noted, there are more than 100 aging federal judges in the system appointed by Democrats, some going all the way back to President Jimmy Carter.
Some may be ready to retire but are trying to out-wait Trump. Others might be willing to take “semi-retirement,” in which they are officially replaced but still serve on the court and rule on cases – but again, only once Trump is gone.
And while they might have a number of factors behind their decisions and timing, Brookings Institution expert Russell Wheeler told the newspaper that their legacy and succession would have to be part of it.

“Clearly they hold all sorts of reasons,” he was quoted as saying. “But one of them has to be from the Democratic side that I would just as soon have Joe Biden or Kamala Harris appoint my successor as Donald Trump.”
And that’s not all they’re doing.
The left has been quietly talking up a plan to expand the Supreme Court and stack the bench with liberal judges.
“They want to pack the Court, and aren’t even willing to tell the American people who they are going to pack the courts with,” Severino said on Twitter. “What are they hiding?”
Of course, even the best-laid plans can go awry when it comes to judges, who often behave differently once given a lifetime court appointment, especially on the Supreme Court.

Reagan appointees Sandra Day O’Connor and Anthony Kennedy, while leaning conservative, were often swing voters who were as likely to side with the left as they did the right.
Chief Justice John Roberts, appointed by President George W. Bush, has turned out to be far more centrist than anyone expected. And early in his first term, Justice Kavanaugh has already sided with the court’s liberal wing on at least two key rulings.

On the other hand, all of this is moot if Trump wins reelection in 2020 – which is why for liberals and conservatives alike, the stakes have never been higher.
