Justice Brett Kavanaugh, you’ve got some explaining to do.
That’s the message coming from top conservative critics who are upset with the justice for costing former President Donald Trump another shot at a major case in the Supreme Court.
The ex-president had been hopeful that an election lawsuit case out of Pennsylvania would be seen by the highest court in the land.
But that plan was dashed when Kavanaugh broke with conservative justices Neil Gorsuch, Clarence Thomas, and Samuel Alito.
His vote flew in the face of conservative hopefuls that the court would see the case and decide on a stronger precedent for voting laws in America — following a controversy over the integrity of the electoral system tore the country in two.
Those concerned had been hoping the Supreme Court would sort out the misunderstandings and set the record straight once and for all.
The justices who indeed were interested in seeing the pro-Trump case were left stunned by Kavanaugh.
Justice Thomas led the way, writing a scathing dissent that was seen as a shot at Kavanaugh.
“We failed to settle this dispute before the election, and thus provide clear rules,” Thomas wrote. “Now we again fail to provide clear rules for future elections. The decision to leave election law hidden beneath a shroud of doubt is baffling.”
Critics note that Kavanaugh’s decision to ignore the pro-Trump lawsuits may have stemmed from the Jan. 6 Capitol storming.
Julie Kelly of American Greatness wrote that Kavanaugh — who in the past appeared to be open to seeing the case — clearly had a change of heart.
“One can only assume since Kavanaugh changed his pre-election position on Pennsylvania, threats of promoting a ‘Big Lie’ about election fraud got to him,” she wrote.
In other words, after the fallout of the election, Kavanaugh may have become disinterested in touching a political case.
Of course, this is just the latest case in which Kavanaugh has disappointed conservatives banking on him to be an anchor on the conservative side of the Supreme Court.
In fact, he seems to have gone incredibly liberal during his tenure.
But Kavanaugh will get another chance later this week, according to The Hill, when he’ll get the opportunity to discuss another Trump lawsuit out of Wisconsin.
